Appeals Court in Atlanta has the same documents ready to act the minute this Clinton appointee doesn't act. I would take my chances with judges of the Atlanta circuit.

Unfortunately, the judge who is holding the 3pm hearing is a Clinton appointee. That's all I need to know to figure out what to expect.

People on a local radio talk show I am listening to now are blaming Terri because she had the eating disorder which led to her heart failure. They are treating the HINO like a saint. They don't want the government in their business.
They say Terri should have met her maker years ago. They believe the HINO, basically.

It means the same thing as when SCOTUS refused immediate relief the other day - unlikely to succeed on the merits.
He will probably rule the law unconstitutional.
That's all any of the Judicial Oligarchy has to do - just keep saying no.

You said it. I was pretty vociferous about my anger over this on Friday... but I prayed it quite a lot this weekend, and I realized that at some point, if we are truly people of faith, we need to give it to God. He's heard our multitude of prayers.

Let His will be done.

He does need to review this thoroughly before rendering a decision but I have little faith in a Clinton judge and hope I am wrong. There had to be a reason the Circuit Court of Appeals in Atlanta was given the same documents to review -- I trust them.

Bit off topic, but does anyone know for sure if there is indeed any money involved in this case. Does Michael Schiavo stand to gain by his wifes death. He said on CNN that there was NOT any money involved but I have heard otherwise. Anyone have facts on this?

Well whatever it is, if anything, would be less than a million, and he already turned down a million to walk away.

Michael won a little over 1 million in the 90's in a malpractice suit.
The money was earmarked for Terri's therapy.
Instead a great chunk has gone to George Felos.

I've read that approximately $50,000 is left.

He also stands to gain approx $300,000 from a life insurance policy when she dies.

He has refused a payoff of $1 million

I saw on one of the news nets that in the late 90's Schiavo got a 1.1 million dollar settlement from someone.

I wonder where the money went.

I heard this morning that Terri has never receieved a PET scan or an MRI.

In an emrgency proceeding of this type, the judge could have signed the order minutes after receiving it. He's using up the better part of another day in a situation where he knows Terri may die at any time and that the parents need to push an immediate appeal. IMHO the judge is demonstrating total insensitivity to the Schiavos at this point. In light of Congress' extraordinary action to create a federal review, I think it's reasonable Congress didn't intend a review of a few hours. Congress expected a temporary restraining order to buy time. I know the judge can do whatever he wants, but this appears outrageous to me under the circumstances.

Keep in mind the judge knew this was coming and being in Florida he undoubtedly knows the issues in detail and has formed his own opinions.

I hope I'm wrong, but I have seen federal judges sign or refuse to sign TRO's in far less time than this, under much lesser emergency.

This order would only be in effect for 10 days until it must expire unless replaced by a preliminary injunction. All the more reason most judges would have signed an order this morning and scheduled a hearing within about a week. I hope I'm wrong.

I believe there would have been money if all went smoothely for him at the outset. The balance of money that was going to therapy would have been his, I believe. Instead, it's going to lawyers.

The Book of Proverbs has a lot to say about avarice, and where that money ends up...

Clearly, Schiavo is misguided. Even if - EVEN IF - he really thinks deep down in his heart he's doing the right thing, he's doing the wrong thing by being disobedient to his Catholic faith....
