Actually, starvation would get them thrown in jail, and the Pro_Deathers would be livid with hatred of the "fundamentalists". And rightfully so.

IMO, this entire case is about protecting Right to Die in the courts, and possibly Roe v. Wade. The judges know exactly what a law based ruling would do to their ideological position. And that, to them, is unacceptable.
