Not even here--someone posted the article, and it was removed and the poster banned. But it is an interesting article, if people want to look for themselves. (No, I won't post a link--I'm not that anxious to be banned.)
hearsay is acceptable in a court....any court ?
This guy probably has more in common with OJ than with Peterson--Peterson didn't get away with it, these guys just might.
actually, this probably has the best chance of all. an administrative department has its own jurisdiction over matters, and generally, it is not bound by prior case law.
I guess one question is whether an action by the state agency even comes within the ambit of the district court's order. Perhaps the order just directs the hospital.
I think this would be a new matter, not contemplated by earlier rulings.
Here is what I think could happen: the state agency could get her, reinsert the tube, and then there would be a showdown between the district court and the agency, probably to the Florida Supreme Court. It would be a matter of procedural law at that point.
BTW, MTOrlando, Orlando is one of my favorite places in the whole world.
I think it's time for us to let go. We've fought a good fight. Unless we can wrest custody from Michael Schiavo, any intervention now will only be a stopgap measure. The courts will eventually put her back in his clutches.
I fear at this point that she will already be in advanced and irreversible organ damage/failure, and now experience continuous suffering, even if the tube is replaced.
The battle lines can't be any clearer drawn than they are now. The justice system is tyrannical. There isn't enough soap in the world to wash the blood from their hands...
Please, no flames. I've ached and prayed and wept over this crime for the past week. There is a better place for her, but we will continue her battle on earth.

It's called "a cover-up" all the way up to the top.
The downside is that now she may be truly TRULY suffering from organ failure/damage. Now, she may truly need artificial life support - it's been six days.
Florida proves itself, once again, the most dangerous place to live in the United States...
I'm not sure the time is now. But even if it's too late for Terri, I'd like to work towards changing some laws and possibly towards criminal prosecution for Michael Schiavo.
Maybe they could find something to charge her with and arrest her. They would take custody of her then.

good you just fold up and go home. i bet it would be different if it were your child or loved one. it aint over until the thin woman dies. :-(
I think that's exactly what we need to start preparing for.
But if she's suffering organ failure... let her suffering end... The window is closed.
Florida Stat. Ann. 798.01 - Living in open adultery:
"Whoever lives in an open state of adultery shall be punished by imprisonment in the state prison not exceeding two years, or in the county jail not exceeding one year, or by fine not exceeding five hundred dollars. Where either of the parties living in an open state of adultery is married, both parties so living shall be deemed to be guilty of the offense provided for in this section."
If it's too late to use this to void his guardianship, or even to just arrest him to keep his attorneys off balance, at least it could provide some small payback.
We need more government involvement not less. I'm sure Terri will be so thrilled that she can look forward to 15 more years of blankly looking at the ceiling.
If she could she would thank all of you...
