Jeb must act NOW, and he can, says Keyes

Thursday, Alan Keyes appeared on MSNBC's Scarborough Country with Joe Scarborough, and on Joseph Farah's national radio show, and declared that Gov. Jeb Bush not only possesses the "supreme executive authority in the state," but must act now to save Terri Schiavo. When asked if Gov. Bush has done enough to help the disabled woman, Keyes said, "Of course not. He hasn't done anything. She is being starved to death!" Keyes made it clear on both programs that Gov. Bush needs no permission from the courts to fulfill his statutory and constitutional duty to act in Terri's behalf, since the executive is equal to the judiciary. I have never in my life seen such goings on and it all started in 2000!
I can't prove it but it probably started long before then. It was just below the radar.
What good are allies that don't make the good fight when it counts? When they turn tail and run when the real battle starts?

I have lost a great deal of respect for him. Judges need to be reigned in. This was a good opportunity to do so. 27.6% 1,255

Jeb Bush lacks the testicular fortitude required to be a real leader. I hope this fact keeps him from holding future office.

Well, being a lawyer, can you tell me why Jeb Bush does not have the executive power to ingore courts that have abused their powers? Seems there are just as many conservative lawyers saying that Jeb can do more! What is the truth?

The world is so troubled now - the terror, unrest, dissention, criminal and immoral behavior are at a pinnacle. Daily new chaos is erupting, events of great trouble are piling heel upon heel, and we are spinning in a world filled with stress laiden stories. Terri's fight is a prime, planned event of the devil's most devious, deceitful, design.
It is not a coincidence that these two people are suffering together while the whole world watches. It is also not a coincidence that this is occurring in Florida with Jeb Bush at the helm of government there, while his brother, George W. in charge of our nation. These two leaders who have deep moral beliefs and spiritual convictions are the thorns in the devil's side that he cannot tolerate. The fact that this has become a political game is the devils planned effect.
And as this unfolds and tears at the threads of judicial robes, and political "suits" Satan is cheerleading on the sidelines enjoying the volley. Whatever the outcome, whatever the time of their deaths, we must all remain ever vigilant, be most fearfully aware, and pray with the greatest fervor than at any other time in our own recent history.

Governor Bush pledged to uphold the Florida constitution as he understands it, not as it is understood by some Florida judges. He is the rightful representative of the people of Florida and he is the chief executive, in whom the power is vested to execute the law and protect the rights of citizens. He should use that power to protect Terri's natural right to live, and he should do so now.

If he does more, then we've got a constitutional crisis because we're on unchartered ground.
Basically, you'd have the courts saying "we're the final authority on this," and you'd have Bush saying, "no, I'm the final authority on this."
In the abstract, it's not clear to me how it would come out as a LEGAL matter. The people who wrote the constitution intentionally did not give the answer to that question because they wanted the 3 branches of government to resolve that issue by fighting among themselves--the so-called "conflicting branches of government" idea. They thought that if that's how they set things up, then in the final analysis, it would be the desires of the people that were ultimately the deciding factor, because if one branch of government took too much power, then the other two branches--and the people--would ultimately smack it down.
So it's not clear who wins that fight, just from reading the constitution. However, as a practical matter, in this particular case, Bush would lose. The reason why he'd lose has nothing to do with what the constitution actually says, though. The reason is that the majority of the voters agree with the judge, and wish Bush would stay out of it. You can argue about whether we're talking about a 60% majority or an 80% majority, but it's pretty clear, I think, that the majority thinks the tube should be pulled. All you've got to do is read the posts on the Freerepublic to see that. Even the conservatives are divided on this issue.
Of course, that does not dispense with the moral issue, but we live in a democratic republic, and the majority controls, even if the majority opinion is immoral. Bush could defy the court, but it would not end in a pretty way. Possibly, he could end up in jail. As I said, we are on unchartered territory.
He's smart to save his ammo for a fight he can win. He can't win this one. He can win the gay marriage one, for example. That's why the courts have not pushed the gay marriage fight here in Fla. They would like to, certainly. But they know they'd lose for the same reason that Bush knows he'd lose this fight. The courts are smart enough, at least in Florida, to not take on a fight they'd ultimately lose.
Nonsense, lawyer. Why did the executive, as a co-equal branch of Florida government BUT the one tasked to defend the citizens, go first to the executing Judge and ask his permission to remove Terri to protect her from the executing judge's sentence? Jeb is a disgusting posturer, nothing more. He has exhibited clintonesque leadership, thrusting his timid wet finger up to see if Greer will blow on it. Disgusting
Greer signed off on Michael Schiavo raiding Terri's $700,000 awarded for her rehab to pay George Felos more than $300,000 for his efforts to have her 'legally' put down. Felos turned around and donate a hefty chunk to Greer's re-election campaign. Pat the governor on the back for staying in his place while the supreme florida judiciary runs things.
So, we basically have no protection as individuals anymore. That makes this a democracy. Mobocracy. Whatever the mob wants, they get. The govt. loses legitimacy, too, then.
