If not Terri, at least the rule of law, could be saved out of this sorry affair if President Bush, or some really gutsy prosecutor with the Civil Rights Division of the DOJ, would use this law as the basis for arresting Judge George Greer, George Felos and Michael Schaivo.

If nothing else the denial of Easter Communion to Terri Schaivo 'under color of law' is a violation of the constitutional guarantee of freedom of religion, both hers and that of the priest who wanted to commune her.

I think you missed the point of the appellate review, to wit: Judges are free to choose which laws they would like to follow and which laws they would like to ignore.

While I agree with your thoughts the rule of law and the Constitution have been tossed in the dustbin. The black robed dictators have taken control and will not allow the Constitution to bother them in their head long movement toward the complete take over of our nation. We can save some money by the Congress disbanding so that we will not have to pay them but I do not see that happening they will be kept on as figure heads to play golf, have parties and raise their voices as if they had some authority to do something.

A thought occurred to me:

Deathocrats are NOT inconsistent/hypocritical while they are anti-death for murderers while at the same time they are pro death for the brain-damaged, and pre-born people. Since murderers are into death themselves, deathocrats are merely rewarding them (by advocating sparing their lives) for what they've done.

The problem is that there's neither a federal law nor a Constitutional guarantee which 'secures' a general 'right to life', so 18 USC 241 doesn't apply, at least not directly.

Something might be made of the Declaration of Independence's listing of "life, liberty and the pursuit of happiness" as natural rights, along with the Ninth Amendment's protection of unenumerated rights, as giving Constitutional protection to 'life', but it would be an uphill fight.

I am not holding my breath. At this point, I cannot imagine any of our 'leaders' perilously risking their precious jobs and their carefully managed careers attached to the public tit to act on behalf of what is at the most elemental level - right. No, they will massage themselves and their record as heroes by acting within the limits they took on themselves and called the law - even law which is not law because some evil judge said it is so. Oh yes, the law which stands today and is gone tomorrow. Yes, the law which even now is killing an innocent. Yes, one can be very proud of defending and obeying such laws. God forbid that we should ever sacrifice our office and privilege for principle rather than the letter of the law.

I only hope now for a swift death for Terri.

Sad to see laws like this quoted at FR as if they were a good thing. I thought it was the Dims who relished the notion that today anything and everthing is a Federal offense.

well, obviously this law hasn't been allowed as a defense for decades... otherwise the IRS, ATF, DEA, etc would be out of business.. one thing MIRACULOUS that Terri has accomplished is waking some conservatives up to how far we have allowed our gvt to stray from it's basic roots. some of us always knew that. and now Bush is talking about creating yet ANOTHER fed dept.. can you all say Janet Reno?

Well .. this law certainly could be used - however, the burden that an actual "conspiracy" exists - will take time to prove.

Hopefully, someone will be up to that challenge.
