Border Patrol, Minutemen Have Double Standard on Immigration

PHOENIX, AZ (April 20, 2005) - Apparently the U.S. Border Patrol believes that national TV and radio stars don't have to play by the same rules as others.

Mr. Sean Hannity, a well-paid commentator for Fox News, climbed over a barbed wire fence separating the United States from Mexico yesterday at about 3:15 p.m. A few minutes later he climbed back over the fence, breaking federal law by reentering the U.S. illegally.

Mr. Hannity's border violations were videotaped by ACLU Legal Observers. The Border Patrol was contacted, but they chose not to arrest or cite Mr. Hannity for his willful violation of federal law. Likewise, Minutemen in the vicinity of the incident did not take the opportunity to turn Mr. Hannity over to federal officials, as they have allegedly done with all other illegal immigrants apprehended on the border this month.

Federal law, specifically 19 U.S.C. Section 1459(a), requires all "individuals arriving in the United States other than by vessel, vehicle, or aircraft [to] enter the United States only at a border crossing point designated by the Secretary; and immediately report the arrivals and present themselves, and all articles accompanying them for inspection; to the customs officer at the customs facility designated for that crossing point."

According to 19 U.S.C. Section 1459(e), anyone who intentionally enters the United States at a place other than a designated border crossing can be imprisoned for up to one year and fined up to $5,000. Mr. Hannity faces neither of these penalties. Individuals apprehended by U.S. Border Patrol do.

This is the very same crime that Minutemen have traveled across the country to Arizona to stop. While some may argue that Mr. Hannity's actions were not significant, he committed the same crime that all individuals who enter the country illegally commit. In fact, ACLU observers were warned that they would be arrested if they accidentally or deliberately crossed the border and tried to reenter the U.S.

Why is U.S. Border Patrol demonstrating such an obvious double standard? If the Minutemen came to Arizona to watch the border for signs of illegal immigration, why did they fail to report Mr. Hannity?

There is only possible conclusion. The Minutemen and the Border Patrol have one set of rules for television celebrities, and another for hard-working people who cross the border in search of work.

Roger Nash Baldwin was the founder of the ACLU, as well as its first executive director.


Elizabeth Gurley Flynn
At the end of World War I, Elizabeth Gurley Flynn organized the Workers Defense League to fight the anti-labor raids of Attorney General A. Mitchell Palmer. From 1928 to 1938, she suffered from mental exhaustion as the IWW and other leftist groups were forcibly atomized by the government. During this time she had a love affair with anarchist organizer (and womanizer) Carlo Tresca. After her relationship with Tresca ended, she joined the Communist Party USA and by 1941, she had joined the party's National Board. In the early 1950's, she suffered (along with other Communist leaders) the McCarthy era. She was indicted under the Smith Act and defended herself through a nine-month trial. She was sentenced to a three-year term in the Alderson Federal Penitentiary and served from January 1955 to May 1957. After being released from prison, she joined in the middle faction of the CP led by Eugene Dennis, and in 1961 was the first woman to be elected National Chair of the Communist Party.

She was a founding member of the American Civil Liberties Union.

“Rev.” Harry F. Ward“Dr. Harry F. Ward contributed the organizational and conspiratorial genius to the movement. Ward is an identified Communist. In 1908, he was the founder of the oldest, officially-cited Communist-front group in America, the Methodist Federation for Social Action. A year later, he played a part in organizing the Federal Council of Churches, forerunner of the present day, National Council of Churches Identified under oath as a Communist by Benjamin Gitlow, first head of the Communist Party USA; Manning Johnson, one-time leader of the Party's Negro Section; and several others, Ward was branded as the ‘Red Dean’ of the religious field before a committee of the U.S. Congress. Ward posed as a Methodist but for 25 years he infected hundreds of young ministers of all denominations with his blasphemous ideas as a professor of Christian Ethics at Union Theological Seminary. Harry Ward served as the first chairman for the ACLU.






In response to growing concerns, in 1940 the ACLU made a pretense of “barring” Communist Party members from official positions in the organization, resulting in the departure of Elizabeth Gurley Flynn, Harry Ward and several others. But the pretense was paper thin.

Carey McWilliams, had served as a member of the national committee of the ACLU in 1948, and continued to figure prominently in the affairs of the ACLU, even through the 60's had been identified in sworn testimony, according to Government documents, as a member of the Communist Party. He had a record of over 50 Communist-front affiliations and citations and was the editor of “Rights,” the official publication of the Emergency Civil Liberties Committee which has been cited on November 8, 1957 as a Communist front by the HCUA.

Dr. Albert Eason Monroe, served as executive director of the Southern California Chapter of the ACLU. In 1950, Dr. Monroe had been fired from his position as head of the English department of San Francisco college for refusing to sign a loyalty oath. In 1952, Dr. Monroe, U.S. Navy serial No. 316900, was discharged from the U.S. Naval Reserve under conditions other than honorable. In 1953, Dr. Monroe was listed as being chairman of the Federation for Repeal of the Levering Act (ie., loyalty oaths), which was cited as being a Communist front organization by the California State Senate Committee on Education in its 1952 report to the State legislature. Yet in spite of the ALCU's official position on allowing Communists to serve in “official positions” Monroe continued his position well into the 60's.

A California Senate Fact Finding Committee on Un-American Activities, 1948 report found that: “The ACLU may be definitely classified as a Communist front or transmission belt organization.”...“At least 90 percent of its efforts are on behalf of Communists who come in conflict with the law.”

With the modern censorship in the MSM on calling any Communists what they actually are the word has almost become outdated — but it remains as real, evil an insidious as always — and the ACLU remains as much a part of it as ever.

Sinema and the ACLU are so stupid!

For Hannity to have re-entered the United States at an undesignated crossing point, he first would have had to actually leave the United States. I've been to that very same border fence and, in fact, the border fence is 3 feet on this side of the international border. So, there is 3 feet more of U.S. territory before you're actually in Mexico. I saw the broadcast and Hannity did not go 3 feet from the fence.

I've had it explained to me before. Hannity had Sheriff Larry Dever explain it to viewers Tuesday night. He also had it explained at length last night on Hannity & Colmes.

These people don't care about the millions of criminal invaders crossing that border but they'll certainly target a person who never crossed it in the first place. And purely for political reasons.

What a bunch of dopes. "Legal" observers, my ass.
