The ADA passed a new law in 2004 about disabled Americans having access to the courtroom. GREER DENIED TERRI ACCESS TO HIS COURTROOM even though David Gibbs repeated over and voer that Terri could be wheeled into his courtroom and attending her own hearings.

I don't have this ADA law but I know they passed it. That's just one Federal Law that Greer broke as well as Whittemore by not allowing Terri to have a de novo hearing. Whittemore said "tube's not going back in."


She wasn't even afforded consistent representation in her absence!

Good point. Not only is that completely unconstitutional, but illegal as well.

That's just what need in this country...judges telling people they can't eat.

Greer just might as well have said,"I'm sorry ma'am, but your husband simply despises you. I think it would be better for him if you just die. I am ordering that you can no longer eat or drink, and if that doesn't work I will see what I can do about having you suffocated as well."

I still can't believe that America sat by and let this Greer pull this off.

I'm not attempting to try Judge Greer's impeachment here on Free Republic. It's not up to me to pull the facts together. I'll let the feds do it.

Greer is a STATE judge. The feds would not be the ones impeaching him - the Florida State legislature would be.

That is exactly what I am talking about - folks need to get a clear understanding of the issues and possible remedies here - or else they can end up demanding something that is not relevant.

There was no surrogate. Terri did not have a living will(advance directive) so she could not have designated a surrogate

Under the law in Florida as I understand it, in the absense of the living will, the husband becomes the lead surrogate.

The proxy can make the decision only if there is clear and convincing evidence that would have been the wish of the incapacitated person.

Apparently that standard was met, according to Greer. Looks like it needs to be moved to "beyond a reasonable doubt", since a person's life is at stake. It would give a judge a lot less wiggle room.

You make that claim - but now you have to back it up. Find in federal statutes or Florida statutes where laws were violated

the decision to withhold or withdraw life-prolonging procedures from a patient may be made by a health care surrogate

It is questionable whether a feeding tube should ever be described as "life-prolonging procedures" but since Florida law uses the word "artificially" provided food and hydration Greer obviously violated this law, and basic human decency, by denying the parents motion to give her water and food by mouth.

This act by the judge is so outrageous and is such a clear demonstration of judicial tyranny in order to assure the death of a living person who has committed no crime and who at the very least deserved the opportunity to try to sustain her own life by taking food and water by mouth that I do not understand why he is still sitting on a bench anywhere in this country.

No, as I stated, surrogate has a definite meaning in this situation. The husband becomes the proxy and must meet the clear and convincing standard before the decision to remove the nutrition can be ordered. As IleeneWright notes in post #44, Terri was given a guardian ad litem when Michael first petitioned to remove the feeding tube. The GAL found that Michael was not clear and convincing. Plus, as I have noted hearsay evidence is inadmissible.

90.802 Hearsay rule.--Except as provided by statute, hearsay evidence is inadmissible.

90.803 Hearsay exceptions; availability of declarant immaterial.--The provision of s. 90.802 to the contrary notwithstanding, the following are not inadmissible as evidence, even though the declarant is available as a witness:
(4) STATEMENTS FOR PURPOSES OF MEDICAL DIAGNOSIS OR TREATMENT.--Statements made for purposes of medical diagnosis or treatment by a person seeking the diagnosis or treatment, or made by an individual who has knowledge of the facts and is legally responsible for the person who is unable to communicate the facts, which statements describe medical history, past or present symptoms, pain, or sensations, or the inceptions or general character of the cause or external source thereof, insofar as reasonably pertinent to diagnosis or treatment.

Here are just a few of the Florida criminal statutes that apply to what was done to Terri. There are many more state and Federal statutes that were broken including civil law. Also, don’t forget the American’s with Disabilities act, Terri’s right to due process, The fraudulent use of Terri’s rehabilitation and medical funds, and Her constitutional right to life.

825.102, and 825.103 alone are enough to indicate that Greer, Felos, Bushnell, and Michael should all be in jail right now as well as all medical and law enforcement personnel who participated in the act of killing a disabled American.

It never ceases to boggle my mind that Americans are willing to allow judges to be above the law. What a dangerous and idiotic notion. If anything they should be held to an even stricter interpretation than the common citizen.

Prior to Terri, I certainly wasn't naive'. I understood how "politics" worked, but I then, my eyes were REALLY opened prior to Terri, around the election, when I did begin to feel that America seemed to have changed!

I've thought about it A LOT and I believe that America began to change with the clinton administration. At no time in our history was there a Presidential administration like Clinton's!

I can't recall a time, wherein a PRESIDENT literally sold the PEOPLE'S HOUSE OUT for a PRICE! Lincoln's bedroom, etc...under handed campaign funds, funneled through communist entities, etc....

Although politicians were *politicians* and everyone always just accepted the old politicians are *politicians* adage and mindset, I've never in my life seen such, crooked, underhanded, illegal, DASTARDLY, mean spirited, EVIL, selfish, unAmerican, hateful, despicable, will stop at NOTHING to WIN political maneuvering, like I witnessed during this last election, which was then.....only CONFIRMED, during Terri's ordeal!

I don't recall the existence of such HATEFULNESS! Such a love for EVERYTHING immoral and just plain MEAN & EVIL! The way that I grew up, with the mindset that I was raised with and others in my age group and those before me, seems to have become the reverse and has become the repulsive trend and mindset today?

Everything that we were told that was bad, is now good, correct, appropriate and the only acceptable minset! Everything we were taught that was good and worthwhile, has now become an EVIL and DISGUSTING mindset!

I am leaning heavily towards AMERICA has CHANGED significantly and DRASTICALLY! But then who the heck knows? I might be WRONG? Perhaps AMERICA has ALWAYS been *this way* and I was just BRAIN WASHED into believing otherwise?

(Wish I could use a SHOCKED emoticon!)

I've just become so deeply SADDENED and so DISAPPOINTED by it all!

I never thought that I would ever live to see the day, when AMERICA would allow and WATCH, a court ordered and court sanctioned DEATH of a helpless, disabled fellow American!

What's more, is the FACT that there are so many other AMERICANS, who have actually JUSTIFIED what took place and call it RULE OF LAW and LEGAL, as if this was a NORMAL, COMMON OCCURRENCE in American!

Although I remain POSITIVE, in terms of my FAMILY, my FRIENDS, my GOD, my FAITH and the fact that I KNOW that there are other Americans such as yourself, who still believe that what was once Good is still GOOD and what was once bad is still BAD...YES, THIS......has FOREVER changed me and has FOREVER changed my whole PERSPECTIVE!

Do you know that before I went to Pinellas in 2003 I actually doubted that there was such a place as hell?

I could not believe that there were actually people who were evil enough to have to be sent to Hell.

But I have looked real evil in the eye now. Some of those people were just thrilled to be helping kill Terri. They were taking great delight in our misery and the misery of Terri's family. They were feeding off death.

One man even screamed at the Schinlders every time they passed by him, and then he would turn around and smile at us with his empty evil eyes.

These times are clearly described in the bible. I'm just sorry that I had to see them be fulfilled during my lifetime.

I know! I've seen it with my own eyes, here in Illinois! I watched Cathleen Crier from Court TV, begin FOAMING AT THE MOUTH, as she clenched her teeth SCREAMING at Joe Scarb.(sp?) about how AWFUL Judge Greer is being DISRESPECTED! I've seen the unthinkable and unimaginable comments on other message boards!

You're so right too, about prophesy being fulfilled before our very eyes! 2Timothy 3........etc

I'm so sorry that you had to see and experience such EVIL! The Bible talks about God turning "them" over to a deprayved mind and their conscience being seared forever! (paraphrasing)

It's not an "oath to the USA" it's an oath to uphold the basic law of America - the Constitution.

I don't care who a judge votes for or what church they go to .. I expect them to follow the rule of law in the Constitution - not their own personal policy preferences.

The Feds can order a Special Prosecutor for this entire fiasco.

The Fla House Judiciary Committee impeaches Judges but they are all protecting Senator Jim King at the moment. If they went after Greer, Jim King would be caught in that net and that would take a mighty large net to hold him.

I did get my feds and my fla legislators mixed up and it was inadvertent.

Anyway, I'm demanding accountability from the feds and also from Florida govt.

Now Judge Whittemore is a Federal Court Judge he needs to be investigated too. His closet is full of skeletons.

“The right to die” and “dying with dignity” are catchphrases that were thrown around quite frequently regarding the removal of a feeding tube from Terri Schiavo, a woman who suffered brain damage 15 years ago. I sincerely doubt most of those people had any idea what they were saying.

How dignified do people consider starva-tion? When confronted with commercials ex-posing the terrible food shortage in many third world countries, “dying with dignity” is not a phrase that jumps to most people’s lips. Perhaps ignorance of what physically happens during starvation and dehydration shields some from considering the gravity of this case.

Medical doctor and ethicist David Stevens has described the process thus: the mouth dries out and the tongue becomes swollen and cracked. The lips become parched and cracked as a thick coating begins to cake the mouth and lips. The eyes sink back into the skull while the cheeks hollow and the lining of the nose begins to crack, potentially causing nosebleeds. The skin turns dry and scaly and hangs loose on the bones. Urine decreases, becoming highly concentrated, and eventually stops completely.

Then, the stomach lining dries out, causing vomiting and dry heaves. Brain cells dry out, too, causing convulsions. The respiratory tract dries out and thick secretions develop, a process that may plug the lungs and airways. Eventually, after the body suffers all these effects, all the major organs fail, including the lungs, heart and brain.

This is an extremely warped idea of “dignity.” It is illegal in the state of Florida, where Terri lived, to put a dog down this way, but for an innocent woman this death sentence will suffice. George Greer, the judge hearing this case has displayed shocking determination to see Terri die. On February 25, he stated that he would only hear motions relating to the “death process” and has denied, without hearing arguments or evidence, the Schindlers’ motion to divorce Terri from Michael and denied, without hearing arguments or evidence, the Schindlers’ motion to remove Michael as guardian.

He also heard, but did not rule on, arguments that Terri should be fed by mouth once the feeding tube was removed and many more very relevant points relating to this case.

Judge Greer skirted and ignored the law more times during this whole fiasco than are permissible to relate in polite company.

What happened in Florida last week was nothing short of murder, and to add further insult to injury, the judge denied the Schindlers’ request that Terri be allowed to receive Viaticum (Holy Communion for the dying) by mouth.

Yes, an American judge denied a citizen the opportunity to practice her religion (he also denied her “unalienable right to life,” but the Constitution and the Bill of Rights are not the rules judges play by these days).

The president has said it is always best to err on the side of life, but what happened to Terri Schiavo last week was no mistake. The unjust rulings of Judge Greer were cold, obsessively calculated, lethally relentless and sadly indicative of the attitudes society has adopted toward the weak.

FV SAYS: If you want to, please copy/paste & email the above to your US Senators and House Members and demand an investigation of ALL THE JUDGES in the SCHIAVO CASES and an investigation of the NINE SENATORS IN TALLAHASSEE who voted against Terri. Who lobbied them so they would vote against her?

Too many RINOs. In New York City REPUBLICAN Mayor Bloomberg tried (and maybe succeeded) a number of years ago to pressure doctors (interns) into learning how to do abortions, whether they wanted to or not.

REPUBLICAN Mayor Bloomberg just received the (evil) NARAL Champion of Choice Award.

Now NYC has approved the "morning after" pro-abortion pill in NYC, according to today's NYPost.

I called the National Republican Committee at 202-863-8500 (I had to hit #3 because the #1 comment line was full when I called) and told them that if they have a pro-life platform they ought to keep tabs on their pro-death Republicans throughout the country, like Judge Greer, et al.

My husband called them and said he will not send them $$

All THAT and so much more FV! Terri was totally denied DUE PROCESS! She NEVER had consistent representation, in her absence, let alone aloud to address the court!

The Guardian ad Litem that Greer appointed was completely IGNORED by the court, upon turning in the report he was odered by greer to complete. Why? Perhaps because the Guardian recognized terri's right to due process, thus he recommended that Terri be assigned a guardian ad litem, either himself, or anoher.

Because the GAL clearly found no evidence of clear and convincing evidence as to Michael schiavo, given the clear and convincing evidence, which was a conflict of interest!

Because the GAL DID not recommend that MS petition be granted, thus not recommending the feeding tube be removed, which was the core reason why Greer assigned a GAL to conduct an investigation and file a report!

Yet, Greer KICKED HIM OUT, because FELOS cried *BIAS*!

How many people know that the GAL's report also indicates that Terri responded to DEEP PAIN stimuli? No functioning CORTEX they say?

**Then, the stomach lining dries out, causing vomiting and dry heaves. Brain cells dry out, too, causing convulsions. The respiratory tract dries out and thick secretions develop, a process that may plug the lungs and airways. Eventually, after the body suffers all these effects, all the major organs fail, including the lungs, heart and brain.***

YOU forgot these additional details of Terri's gruesome "DEATH PROCESS"!

ALL OF THE VITAL ORGANS BEGIN TO LITERALLY *CRACK*!

Maybe it would be better to contact your U.S. senators directly. The stopactivisitjudges.org site seems to be down on and off. I don't know if it's being hacked, or getting so much traffic that it goes down.

Please call your U.S. Senators and tell them you want them to vote for the nuclear option to end filibusters for judicial nominees.

Yes, this is a disgusting chapter in American history. When Nat Hentoff from the Village Voice, Ralph Nader, David Boies and Joe Lieberman join with Rep. Dave Weldon, Tom Delay and Jim Robinson to say that it was wrong to kill Terri, that's a new kind of coalition that represents a backlash against the euthanazis that has nothing to do with party or ideology.

It was inhumane, illegal and barbaric and millions of people worldwide know it.

When I called Charlie Crist office about Terri, the receptionist said to me "Ohhhhh, you're from out of state," and her tone made me think she was hinting that I should not call. I said, yes I am, and I have been considering on retiring in Florida when the time comes, but now if I relocate I will go to another warm state.

(Retiress would be NUTS to retire in Florida after this.)

eeevil conservative, I remember reading, possibly on your website, that Grandma Mae was taken to another state, a more pro-life state, but I can't remember what the state is. Do you know? Thanks.

We believe that America is in grave danger because, increasingly, the judicial branch of our government has become hostile to the concept of faith and
to people of faith.

Where the contributions of religion once were celebrated by our government and protected as necessary for the public welfare, today, many judges are
determined to prohibit any public manifestation of faith. Not only does this fly in the face of history, it also contradicts such expressions of civic
religion as “In God We Trust” on our currency and the President taking his oath of office on a Bible.

What our courts once protected and celebrated they now forbid, under the guise of the “separation of church and state” — a phrase not found in the
Constitution and a concept foreign to establishment clause constitutional jurisprudence prior to 1947.

The American people are being told to deny their heritage and disavow the truth upon which our Republic was founded. Judges are rewriting our
history, destroying representative government and unconstitutionally forcing on the nation radical social experiments — including same-sex marriage
and a culture of death.

We therefore call upon the Congress of the United States to exercise its constitutional authority to stop judicial tyranny – the revision of the original
meaning of the text of the Constitution under the guise of interpretation. At a bare minimum, we believe the following is necessary to stem the rising
tide of judicial tyranny:

1) The Senate should restore its long standing tradition by no longer allowing the minority to block a vote to confirm judicial nominees.

2) Congress should withdraw jurisdiction from all federal courts to hear any challenge to the Defense of Marriage Act, state marriage acts, or state
marriage constitutional provisions defining marriage as a relationship between one man and one woman, which are claimed to be a violation of the U.

S. Constitution.
3) Congress should withdraw jurisdiction from all federal courts to hear all challenges to the acknowledgment of God as a violation of the First
Amendment Establishment clause, rightfully returning these matters to the individual states.

4) Congress must impeach and remove Supreme Court justices and judges of the lower federal courts who insist on substituting their own views for
the original meaning of the Constitution.

5) Congress must impeach and remove Supreme Court justices and judges of the lower federal courts who base a decision of Constitutional
interpretation in whole or in part on foreign law.

6) When and where appropriate, Congress should reduce or eliminate the funding of federal courts, the salaries of judges excepted, that overstep their
constitutional authority.

Constitutionally defiant judges have brought us to a national crisis. Such activist judges have abandoned their legitimate role, usurped the authority of
the other branches of government and created a tyranny far worse than that which the Founding Fathers rebelled against.

Therefore, firm measures are now required to preserve, protect, and defend our Constitution from out-of-control judges bent on forcing their will on
the American people.

We the undersigned appeal to Almighty God to be merciful to these United States of America and request His Divine assistance in restoring our
Republic once again to be “One Nation Under God” with religious liberty and justice for all.

Same thing. That is a solemn oath. And the wording is clear in the Constitution. That monument did nothing to establish a religion. Not a single person was persecuted for his religious beliefs, other than Judge Roy Moore. The established religion is the Baby-Killing Law. Ten Commandments monuments would be one step to help put that 'almighty law' in its place. THOU SHALT NOT KILL.
