Victim Refuses to Marry Rapist

The victim of a sensational rape committed two years ago on Tuesday spurned her attacker's offer to marry her to atone for his sins, saying she wanted to see him hanged.

Bhura, convicted by a court for brutally raping a former nurse of Shanti Mukund Hospital made the marriage proposal just as the court was to pronounce his sentence on Tuesday.

"I will not marry him. In fact, I want him to get the severest punishment. I want him to be hanged so that it will be a lesson for all rapists," the 22-year-old woman told a television news channel.

A court on Tuesday summoned the woman to elicit her view on Bhura's proposal to marry her, saying "he is now a reformed man".

Bhura, who raped and gouged out the woman's eye at the hospital in East Delhi two years ago, submitted his proposal to Additional Sessions Judge JM Malik a few minutes before the pronouncement of his sentence.

Malik had April 27 held Bhura guilty of the offence, saying that the prosecution had been able to prove the case beyond all reasonable doubt.

Bhura further said that since nobody would now marry the victim because of her stigmatisation after the shameful incident, he had chosen to marry her to re-establish her in society and to repent for his act.

Taking Bhura's proposal on record, the judge summoned the victim and her father on Wednesday to record their opinion on Bhura's proposal.

Social activists too reacted sharply to the court's decision to adjourn the proceedings without pronouncing the sentence.

"It is highly objectionable. The court has set a wrong precedent. How can they admit an application from the man? The court is not a marriage bureau," said Brinda Karat, a member of the Communist Party of India-Marxist politburo and a leading rights activist.

I didn't know that Florida and India had a judge exchange program.

Some cultures have very strange ways of handling men who rape and their rape victims, old bible culture included since I do recall a bible story about this.

The obvious difference is that hanging is quick and painless. And if you do it wrong, it won't take as long for the suffering to be over.

This happened in India, right? Depending on the caste, they might hang the woman. Was that out loud?

While this would be a terrible solution in today's society, back then it was an effective punishment, as the rapist had ruined the girl's social value and severely limited her chances of marriage.

A good read on it here: "This is not a matter of having the rapist be one's loving partner, or cohort for further sexual relations."

I don't think it does either. However, in a society that puts a premium on virginity, rape may prevent a woman from being married. Deut 22:28-29 give the girl an option to be provided for a husband. I doubt the obligation in such a situation was on the girl; rather, it was on the man.

For who? The only one really being punished is the victim. Duh...she gets raped and no telling how she was otherwised damaged in the assault, then gets stuck with a man she could never trust not to harm her again or kill her to get rid of her later. That's a terrible solution for the victim in any society.

First, I'm not sure the victim would have been "stuck." Do you have any evidence that the punishment would have been imposed against the victim's desire?

Secondly, it is punishment in the sense that it effectively made the man the slave to the woman for the rest of his life.

Thirdly, as I said, the woman was likely not to be married by anyone else because she was 'damaged' by the man, which was the very reason for the law's existence - to guarantee someone would be there to provide for her. Her parents wouldn't be there forever.

That's one of the most idiotic statements I've come across. You're kidding right? Or were you mixing a social problem(caste) with a religious one?

India's government and laws are secular, as far as I know.

And they would never kill a young woman for not being a virgin, just like they would never bury the widow with the body of her husband. India's secular laws and courts don't always get to the scene of the crime on time.

Now their words seemed reasonable to Hamor and Shechem, Hamor's son. The young man did not delay to do the thing, because he was delighted with Jacob's daughter. Now he was more respected than all the household of his father. So Hamor and his son Shechem came to the gate of their city and spoke to the men of their city, saying, "These men are friendly with us; therefore let them live in the land and trade in it, for behold, the land is large enough for them. Let us take their daughters in marriage, and give our daughters to them. Now you KNOW he had to have some serious influence! I mean, think about it. Can you imagine someone like Bubba taking the stage in a city and saying, "hey, now there's this hot babe I want to do and I know y'all love me and want to see me happy. There's just one little thing y'all gotta do for me. Go get the family jewels snipped." Yeah, right. Somehow I don't think there'd be a whole lot of enthusiasm for that plan.

I wrote a short story on that theme once. If I recall correctly, the seducer's bride payment is 50% higher than is normal -- and the family can collect the money and send the seducer on his way. The notion being that a bigger "hope chest" might compensate for the seducee's compromised status.

Until recently, we had the tradition of the "shotgun wedding" in this country.
