WENATCHEE, Wash. (AP) -- Even though Democratic Gov. Christine Gregoire has been in office for months now, the legal battle over how she got there is still far from over.
Republican Dino Rossi is challenging Gregoire's 2004 victory in the closest statewide election in national history, alleging widespread problems including illegal votes cast by felons and dead people.
The challenge was to go to trial Monday. Chelan County Superior Court Judge John Bridges moved the case to the county auditorium to accommodate the scores of attorneys, reporters, politicians and spectators who planned to attend.
Rossi, a former state senator and commercial real estate agent, won the first count by 261 votes and a machine recount by 42 votes - seemingly a stunning upset for Gregoire, a three-term attorney general in a Democratic-leaning state.
But during a hand recount of 2.9 million ballots, the Democratic stronghold of Seattle made Gregoire the winner by just 129 votes. Gregoire was inaugurated in January, amid protests from Rossi supporters.
The trial was expected to focus on problems involving human error in vote counting that are similar to allegations raised in Ohio last year and in Florida in 2000.
Both sides have been hastily revising their strategies over the past few weeks, as lawyers took depositions from election officials around the state. Neither Gregoire nor Rossi plan to attend the trial.
In a legal brief filed Friday, Republicans alleged for the first time that fraud swayed the election. The GOP was emboldened by depositions last week in which King County election workers said they submitted false absentee ballot reports, with the knowledge of their supervisors, before the election was certified.
If Rossi wins and becomes Governor (by judicial order or re-vote) doesn't that invalidate any laws signed by Gregoire, who in effect was holding the office under fraudulent circumstances?
After all any contract entered into illegally, or any contract that's illegal on its face, is not enforceable. That includes even if you were not the one who initiated the fraud or otherwise illegal act (cannot benefit from a crime). I would assume the same precedent would apply here since she was in effect (and IS IMO) the illegal Governor.

If the judge decides the election was so fouled that it did not conclusively determine a winner, it will serve to destroy any kind of perceived mandate, or any air of permanent legitimacy to her being there. She'll find it impossible to govern.
I say this only because the D's ran wild and raised taxes all over the place this session. They flouted a voter approved cap on spending, and then voted a multi-year gas tax after the voters turned back a 5 cent tax, which was then rammed home by the previous legislature and governor.
They made sure the gas tax came at the end, hoping that initiative mavens would have no shot at repealing the tax via the initiative process. Within DAYS, not only were the people well on their way to getting the signatures they needed, money for supporting the initiative came out of the woodwork.
Democrats are starting to quiver at this point. The election fraud admisstion is going to make it so Gregoire can't govern.
Where any election you can steal is a good one.
It's just interesting that, despite all the Democrat screams of "vote fraud" during the last election, the challenge that still has legs is the one AGAINST a Democrat. Democratic Party, thy name is "projection"...
The sentence you quote spells out a pretty good basis for conspiracy to fix an election. Indeed, if the Gregoire victory stands it would constitute fixing an election.
They are doing the Clintonian defend, deny, delay gambit, as well as taking other cues from the Clinton playbook. Remember with Clinton the strategy changed from denying wrongdoing to admitting that there was wrongdoing, but "it was just about sex" (as if that makes wrongdoing okay). In WA state, the 'Rats have stopped trying to convince people that the election was untainted, but now are playing the "it was only human error" card. IOW, it wasn't fraud, "it is just about stupidity, incompetence, laziness, and mismangement". Well, whatever. That still doesn't change the fact that Fraudoire was wrongly installed as Governor, and that Rossi was cheated. Anyone who cares about honesty and fairness will see through the 'Rat smokescreen.
They don't care that the alleged Governor is a fraud, or that the world knows it as long as they hold power for as long as possible to continue their scorched earth policy of liberal legislation.
'Rats don't care about such quaint notions are honest elections and playing by the rules. They don't care that their candidate holds office under fraudulent circumstances. All they care about is that a 'Rat holds that office. Just like during the impeachment, they didn't care that Clinton was a scumbag and a liar and unworthy to hold the office, all they cared about was that he was a 'Rat. Same with Fraudoire.
Dean must have checked the exit polls in the vote for "Most Odious Democrat". He saw a ten way tie and wanted to put some distance between himself and the rest. DeLay will go to jail?

LOL...You should here the WA Rat party chairman Paul Berendt. Every interview I've seen he naver fails to bring up that the Diebold company who manufactures the voting devices are owned by GOP donors. iirc They tried this in Ohio too.
