Sorry, I'm not following you reasoning and references. Could you spell it out for me?
This deal is about two things.
One, getting the RINOs press, as 'moderate' republicans.
Two, getting the Rats out of trouble so they don't have to vote against nominees that are conservative AND minority.
The process that the GOP wanted to use was a rules change. I assume you know about that.
What this deal will do is ensure that the GOP doesn't get to try that rules change until the white nominees come up for a vote, denying the p.r. advantage to the GOP and handing it to the Rats.
What I suggest would basically force the RINOs and the Rats back to voting against the minorities. It would cripple this deal, because no matter how many RINOs or Rats cross the aisle, the GOP could still ensure a vote under the 60 required, an objection and ruling from the chair, and a vote on the record by the RINOs and Rats that neither of those groups want to end the filibuster and get these minority judges through (and thus campaign charges of racism and sexism can stick to them).
We don't lose, anyway, because the two groups have already said they'll vote FOR these nominees. So why NOT try it?
