Outrage Follows Cop Child Abuse Sentence

TAUNTON — Taunton police officer David Smith walked into Taunton District Court 10 months ago, facing charges of molesting his adoptive daughter.

He walked out earlier this month an ex-cop but a free man, despite admitting he assaulted the child nearly every night for a year shortly after she came into his home at age 7.

In a deal that has been blasted by child advocates and those who counsel rape victims, Smith, 58, was put on what is called pre-trial probation for four years. That means the charge will be dismissed if he stays out of trouble during that period.

That means Smith walks away with no criminal conviction and will not be required to register as a sex offender. He is also expected to be able to keep his pension.......

Walsh said he expects the state will take steps to garnish that pension — once it is approved — for child support for the child.

Although Walsh has said he expects part of that to be used to support the victim, Paul J. Slivinski, executive director of the Taunton Retirement Board, said he is unaware of any such agreement. However, there have been cases where Department of Revenue liens for child support have placed on pensions, he said.

I looked around and didn't see this posted, have it pulled if it has been.

You have to read this whole artical to get the full import. One of my co-workers brought this to my attention and the case has a smell to it.

A smell? This guy should be in prison for life, but gets off because he's a cop.

I'd look into the judge's background. Could be some kind of union payoffs there.

Well, I should have done what you said.

The deal was signed off on by the DA!! And CPS!!

And, of course, the girl, because she wants her daddy back.

As near as we can remember the Judge is an ex State Sen who has an unfortunate accident at the polling place, he lost.

We can't remember if he is a Jane Swift appointee though, if he is it would be in character.

It smells alright.

Give the Perp his pension so he can provide support for his victim? What a laugh! First, he'll probably succeed at not ever having to pay a dime for this purpose and, second, this dildo DA says the 'no punishment' deal worked out was to protect the victim yet he hopes to have her molester involved in providing ongoing, long term financial support, i.e. involvement in her life for the foreseeable future.

Finally, what about the other victims this Perv will create in the future while he is out, free to victimize instead of being in jail for the next 20 years or so. A really ignorant and dangerous deal if you ask me.

That is part of it, we figure. The funny thing about this is that any DA worth his salt would have had this in Superior Court and run for reelection on it.

And this guy will probably answer calls where there is child sexual abuse.

I had a police officer working for me once who was charged with abusing his wife. The investigation revealed that it wasn't the first time. He was a Dod cop living off base in Panama. Panama had jurisdiction in the case and wouldn't prosecute him. I fired him. Caught hell from the union but like I told them cops who break the law can't enforce it and the policy at the time was that if you were arrested for a domestic abuse case you could not carry a weapon. Couldn't carry a weapon can't put him on the street and I was not about to create a job for him.

HANG the PROSECUTOR and JUDGE responsible for this "deal". This is what happens when the legal system has no desire to protect the victim and future prospective victims.

Sounds like he cut a deal on one count, I don't know. Normally DSS would be on this like smoke on a wet fire.

THIS WOULDN'T HAPPEN IN OUR COUNTRY if we weren't in a deep educational Crisis, doing more damage to the nation than the Great Depression which was prolonged through policies resulting from that same educational crisis. Here are two related articles that you might find interesting, one is on "how conservative graduate students are brought to heel" and the other is on the intellectual umbrella that the Left always retreats to when morally or empirically cornered.

And I'd definitely recommend the BRAINWASHING 101 documentary which very tellingly the lib media hasn't given a fraction of attention to as it did the propaganda film of Michael Moore.

What did the Union do? I only ask because I'm interested in anecdotal examples such as this and the one that we both read about here which follow a certain pattern, or M.O. so to speak.

The victim in the case was a foster child adopted at age 7 by Smith and his then-wife.

It was to be a stable home for a child who needed love.

But accusations of marital infidelity led to the breakup of the Smith marriage and Smith's estranged wife moved out of the house — and the state — leaving the child behind.

It was at that time, authorities said, that Smith, now alone to care for the girl, began abusing her.

Prosecutors said Smith admitted to sexually abusing the child for more than a year while she was 7 and 8. The abuse stopped when he married his third wife in 2001, prosecutors said.

The abuse involved her touching his genitals, sometimes with her feet, every night for a year, according to prosecutors. Walsh said there was other improper touching, but declined to go into detail except to say "it was significant."

Smith was charged after he told a counselor about the abuse. He later repeated the admission to state police and resigned from the department last July after his arrest.

I'm sorry that I took a bit of time to respond, I was multitasking a bit.

I hadn't gone to the link on this one, you sure got me to do it.

I'm not very sure that we are dealing with a RINO here, since the Enterprise writer alleges that a first time offender like Smith would only have had to do 5 months of time according to sentencing guidelines and he faced charges in July of 04.

The justice system is pretty twisted up. the way that the judge and the D.A. bent the law is just criminal and totally corrupt. I need to know more, but it seems as if the D.A. is really politicing to condone the acts of pedophilia under the same strategy that they use on other issues: talk about one thing while you are pushing for something else. Paul Walsh said that he was for letting the man walk because it was best for his victim. That is absolutely absurd. And she can't talk to the court but she can talk to councelors?

How can it be that if Smith didn't admit any guilt he is under probation????? This is a very warped scenario, I don't think that the people of Massachussettes are really aware of their situation.

Thanks for the small nudge you gave me through your reply, believe it or not, I've been tuning it down a bit when it comes to politics, but that might not be very obvious because I still come around to FR to see what's going on and make comments every once in a while. A flood of ideas has just come into my mind about continuing to pound on the libs and defeat them some more at the polls and exposing their corrupt influence in our country. We've gained ground since 2000 and Newt's CWA, and even as I've been tempted to take a complete break for a while, I often get reminders like these about why we have to keep it up and to turn up the tempo sometimes.
