Yes. And change the circumstances....a little more secluded in the park, a little later, she a little weaker, he a little stronger...the outcome could certainly have been rape or worse. Hold him, charge him and if found guilty hand him his holy book and ship him off. But if his embassy helps to get him out with a promise to show up for trial (possible) you will never see him again.
