SCOTUS Ruling Opens the Door for Government to Destroy Unpopular Private Clubs, Businesses

On June 23, 2005, a divided US Supreme Court stunned most Americans when it ruled 5-4 that local governments may seize people's homes and businesses against their will for private development in a decision awaited by both local governments and property owners. The case under consideration was a defeat for Connecticut residents whose homes are slated for destruction to make room for a private office complex re. Kelo et al v. City of New London, 04-108. They had argued that cities have no right to take their land except for public projects such as roads or schools. As of this decision, however, cities may now destroy private residences and clubs for projects that will provide more taxes or other economic benefits.

This has to be a godsend for towns and cities that have been stymied so far in their attempts to shut-down any businesses, corporations, or private groups of which they disapprove. Private gun ranges, airfields, RV tracts, hunting preserves, fishing resources, minority religious congregations, newspapers -- all are now fair targets for seizure and closure "for the economic benefit of the people." Chicago Mayor Daley's unlawful seizure and bulldozing of Meigs Airport in 2003 is now moot since he can say he did it "to improve the local tax base." Numerous gun ranges and hunting clubs across the country can now finally be closed by NIMBY pressure on the local city council or board of selectmen. Don't like those awful ATVs buzzing every weekend? Presto! That ATV tract will certainly return more taxes as a new strip mall. Resentful of that weird religious group meeting house down the road? No problemo. Their church is now a McDonalds. Don't want a lawful gun dealer in the Peoples Workers Paradise of Cambridge, Massachusetts? I feel so much better now that it's the local Ben and Jerry's.

This ruling only reinforces the general and growing consensus that the US court system is broken and that activist judges are dismantling the country, the Constitution for most intents and purposes having been flushed. The fall-out from this inexplicible ruling will be fast, fierce, and tragic. Stand by.

I look forward to the day when some creative government official uses this case as a precedent to support an initiative to "enhance property values" by forcing all racial/ethnic minorities out of their homes in town.

I was absolutely stunned to read about this. What the hell is the matter with the SC? First McCain Feingold now this. Our rights are being removed one by one by this court. What recourse do we have?

If the government can get more tax revenue from the new enterprise than what was there before, that's for the public good.

Which leads to another issue - besides using this ruling to close "unwanted" businesses, how long before some community looks at a church and thinks, "Hmm, they pay no taxes. But if we TAKE the land and put up a Denny's, we could get more tax revenue, which is good for the public"?

Guess who joined the majority in this case. Justice Kennedy once again...he's getting worse with every case. The case shows that replacing Rehnquist and O'Connor won't be enough. We also need to get rid of Stevens...

Don't bother, they'll come after that stockpile next. It's unfair for you to have all that money while others suffer under large credit card debts.

They pay... what THEY think your property is worth. If it isn't enough for the mortgage, too bad.

With rulings like this, I wouldn't count on it. After all, money is just another form of property.

Maybe your community needs a new homeless center. They might decide that "your money" would be put to better use by funding it.

How is "economic benefit" defined? Anything for the "common good"?

I can see ecofascist politicians taking homes to turn the land back to the prairie/desert/forest in the name of the "common good".

You should lack faith in Republicans for good reason. Ol Senior Bush was a true liberal who picked libs for the court. The RINOs in congress allowed the most bias and overtly communist (former ACLU pres) judge ever to sit on the court - Ginsberg. And I dont expect Bush and his minions of RINOs in the senate to fight for anything. We have a bunch of whimpy POS poliiticans who cry over their fear of the UN appointee while our men and women fight for the rights that they would gladly give away if someone calls them a name.

I agree. It is a diaster. Poor judges who should never sit on a bench.

Circle slash property rights. They can build a Shell Oil station on your property and give you "fair compensation" for it. You do have the right to spend all your money objecting to the price.

The Supremes have no concept of what the Constitution says.

I'm not could speak for them, but the term "powder, patch, ball" comes to mind.

have to read the decision but if it is as reported then we as a republic are in very big trouble indeed.

any prime property wanted by friends of politicos can be condemned and taken for pennies not for public roads or water supply but for another citizen to profit from.

Will the American public see this for the tyranny it is??

impeachment is the only answer- the leftists on the court are going no ware while BUSH is president.

I share your worries about Republican nominees. Three of the five justices in the majority were Republican nominees and Bush is going to have an extremely difficult time getting anyone faintly conservative through the Senate. This decision undermines one the foundations of Western society and could lead to fascism with the state determining the "proper" use of property under any circumstances.

Today, it is you, me, and alot of other americans who realize what is happening to this country with what the SCOTUS is getting away with! You would think that there would be public outcries across the country with this ruling!! It is absolutely insane that they can get away with this!!!

I say don't just complain here but email your house rep and senators and demand a new constitutional amendment so that the 5 idiots on the SC will now know what "Public Use" means in the 5th amendment. Here is the text I used, use or abuse as you see fit




As a Republican who very much believes in the power of individual freedom and the right to own property which has been a Constitutional guarantee and a bedrock of our American society. I am appalled by today's Supreme Court decision - "Supreme Court Rules Cities May Seize Homes" that allows a private developer to seize a persons land/home via a city's (or States) eminent domain power just so they can put a office building or shopping mall on it.

By the logic used, anybody with the help of the City Council or County Board could grab any other person's home & land if they are just willing to build a more expensive home on it or apartment units or a store etc. that makes the property more valuable, and thereby increase city/county tax revenues.

Please consider sponsoring a new Constitutional amendment better defining what is meant in the 5th amendment the term “Public use” as only property fully owned by a State or Local Government entity and not otherwise leased, rented or transferred in anyway to a private company or person.
