A former IRS agent who believes citizens are not required to pay federal income taxes was acquitted today on charges he attempted to defraud the government.

Joseph Banister, a Certified Public Accountant in San Jose, Calif., had been telling his clients they don't need to file federal income tax returns because the 16th Amendment, which gives Congress "power to lay and collect taxes on incomes," was never properly ratified.

Joseph Bannister used to work for the IRS. He was shown the door by his superiors when he asked some unwelcome questions about the legitimacy of the income tax system. For what its worth, the IRS honchos never did answer them.

It never was properly ratified by all states. Since the grand socialist, FDR, we have been taken to the cleaners...

Very, very, very bad advice from my (limited) knowledge. Failure to *pay* is not a crime. Failure to *file* is. I’ve seen how that plays out too many times.

I think he's right but since when has respect for the law stopped our government from doing what it wants? The income tax is "voluntary" only in the sense that you don't have to pay if you don't have enough money for the feds to bother going after you. If you do and you willfully fail to file a return, expect to meet the end of the mailed fist.

Uh, the 16th Amendment was "ratified" under the Wilson administration.

He is right, the 16th has never been properly ratified and is thus completely invalid and unlawful... however, to my shame, I still pay taxes and file returns because I quite frankly fear the jack booted thugs will break down my door at 4AM in the morning.
