In dissent, Justice Sandra Day O'Connor voiced the anxiety of many: "The specter of condemnation (now) hangs over all property. Nothing is to prevent the state from replacing any Motel 6 with a Ritz-Carlton, any home with a shopping mall, or any farm with a factory."

Sandra Day O'Connor swings and misses a lot, but this time she hit a grand slam home run. Unfortunately for us, we needed one more run to win.

To me, this ruling divides the court more than any other on ideological grounds. Scalia and Thomas are solid conservatives. O'Connor and Rehnquist have some bad days, but they usually make the right calls. I can't say that about Kennedy. And I certainly can't say that about the 4 liberals, all of whom should resign for the good of the country.
