Speaker creates committee to develop eminent domain guidelines for state (Florida)

TALLAHASSEE — Expressing concerns about a U.S. Supreme Court decision that broadened governments' rights to use eminent domain proceedings to take private property, Florida House Speaker Allan Bense on Friday created a committee to develop guidelines about when and where the proceedings can be used in the state.

Bense, who has described himself as a libertarian in opposing government intrusion on personal lives, said Floridians should be wary of eminent domain proceedings used to benefit profit-driven private entities.

"Private property rights are a fundamental principle upon which our nation was founded, and government should only be allowed to deny a United States citizen those most basic rights under the most extraordinary circumstances," he said.

I know a lot of houses were taken down to put in the Wonderwood Expwy in Jacksonville. Parts of that area don't look a whole lot different than they did before the project started.

This is nothing less than a license to steal, and States depend on Federal dollars too much to have much heart in the fight. This is massive paydirt for every scumbag lawyer on the planet, including those within our elected legislature. Property ownership rights can NEVER be trifled with, our country's future depends on it, as it always has.

I applaud Florida for their efforts, but this decision cannot be allowed to stand, we need legislation to correct it. We need conservatives/strict constructionists on the SCOTUS to make sure it never happens again. Where in the heck are our elected Republican leaders on this?! All I hear is silence!

I say, the decision by the USSC is unconstitutional. No where in the constitution does it say eminent domain is for private property. This is not the first time this has come up and time after time the courts have said that eminent domain is ONLY for PUBLIC use. What part of that does the USSC can't see, read and understand.
If most of the USSC judges can not interpret the U.S. constitutional, then some how some way the citizens of the U.S. are going to have to get rid of them.
These judges are the ones who are the traitors of the U.S.

There will probably be a lot of land grabs if something isn't done. They can make a lot of money.

I wonder where Speaker Bense stood re Jesse Hardy's property?? I'm going to try and find out!

Bense and Tom Lee have a bit of tug of war...

Bense wants lawsuit limits and Lee doesn't like the idea.

IF the rubber ever meets the road on this issue it would be good but it might not even come to fruition if the rams are always butting heads.

I really don't understand a bit where the judges heads are. They say 10 commandments can't be in a courthouse but the commandments are in the Supreme Court building.

It's like their recent rulings are out of the Twilight Zone. What's in the DC water?

This is a step in the wrong direction.

Right now there's widespread outrage and much potential for a legal redress to the Kelo outrage.

The elite know from years of manipulating the political system than to try to outright oppose the upcoming backlash. It would oppose them for what they truly are, it would use up too much political capital and they'd likely lose. Their best move right now is to co-opt the backlash into something they can control down the road when the issue isn't so hot.

So they claim to be 'libertarians' (BS! see their Marlin's efforts) and set up a committee. Later, politicos beholden to developers will control the committee of course.

We need a amendment to Florida's constitution stating that eminent domain is only to be used for public infrastructure. Right now it says "public use", which after the Kalo decision means any damned thing they want.

I want to help put a state constitutional amendment on the ballot in Florida for this purpose. And I'm looking for like minded Florida voters.

Got a committee of your own or have a committee in mind that would sponsor it?

Inorder to get an amendment on the ballot:

Petition initiative must be filed by policitial committee.

Must be filed and approved by Division of Elections.

Must get a % of sigs from last election....roughly 611,000 and a certain percentage of the total has to come from different districts.

Once that amount of sigs has been accumulated then the proposal goes to FL Supreme Court for approval.

I figure I'm not the first person to come up with the idea, so right now I'm looking for an existing committee I can support so I don't have to reinvent the wheel.

Thanks for the amendnment details. We can rest assured that the best in the business will be hired by the elite to knock our amendment off the ballot. We must be absolutely certain the wording of the amendment is bullet proof to legal challenge before we spend our limited recourses to collect signatures. We're going to need professional legal help.
