Biden: Dems Will Filibuster Janice Rogers Brown

Sen. Joe Biden said Sunday that if President Bush nominates recently confirmed Circuit Court Judge Janice Rogers Brown to replace Sandra Day O'Connor on the Supreme Court, Senate Democrats will launch a filibuster.

"If [Bush] sent up Edith Jones, I could assure you that would be a very, very, very difficult fight - and she would probably be filibustered," Biden told CBS's "Face the Nation."

In the next breath Biden corrected himself, saying, "I misspoke, I misspoke. Janice Rogers Brown is what I meant to say."

Asked whether that would break the Senate's much heralded compromise last month not to filibuster judicial appointments except under "extraordinary circumstances," Biden explained:

"[The Supreme Court] is a totally different ball game . . . A circuit court judge is bound by stare decisis. They don't get to make new law. They have to abide by [legal precedent]."

Asked if O'Connor's retirement was more likely to provoke a filibuster than would have been the case had the more conservative Chief Justice William Rehnquist retired, Biden responded: "Probably."

I'm actually glad they are listing the ones they would fillibuster. someone should run down the list with Biden - Luttig, Garza, Alito, Brown, Owens - let them show their hand early.

Luttig is clearly the best choice - we could put Brown up there, let them fillibuser and smear her, play the race card, withdraw her name, then put Luttig up there.

Just shows the hypocracy of the left, if she was so bad that they have to filibuster her, why did they make the deal to grant her a floor vote? They would have stuck to their guns and denied her confirmation vote if the fight were a real, idealogical fight. It's her conservatism that's their problem not her ability to adjudicate.

Liberal Bigotry

The problem with Janice Rogers Brown is that she doesn't fit the bigoted stereotype of liberals like Joe Biden or Alan Colmes. In their mind, black Americans have no right to think for themselves.

They dislike conservative blacks, who think for themselves, much more than equally conservative whites.

Luttig would get my vote. However, he is a white Christian male of European descent. He will never get the nomination.

If the President wants to nominate the first Hispanic, I don't think it will be Gonzoles but rather Garza. He's a Marine to boot.

All this said, the fact that Biden has shown his cards to expert poker playing President, I'd wager that Janice Rogers Brown has now moved up considerably on the short list.

Good ... nothing better could happen than to expose the RATs with Justice Brown. Take the fact that they just confirmed her with Brown's position on property taking and they will have little of substance to claim for their actions. This might be better than the nuclear option ... let's call it the J-BAM option!

Justice O'Connor wrote in her resignation that she would serve until someone was elected to replace her. That means no recess appointments since their is technically no vacancy.

Biden just admitted on national TV that he willfully violates the required Article VI oath he has taken to support the Constitution - the Constitution that gives Article I Section 1 exclusive authority to create legislation to the legislative branch, not the judicial branch.

That would work. And we have the happy choice of either "nuking" the Rats', or letting them go into yet another mid-term election as obstructionists. Think about. Even if we don't nuke, it won't bother conservatives a bit if the SCOTUS is semi-paralyzed for a session with 4-4 non-decisions, but the swing-voters are apt to consider it a crisis (brought about by Dem obstructionism) and so are the Dems (either demoralizing their base, or driving it to demand further damaging and ineffective extremist posturing from Rats in congress).

Contrary to some pubbies, I think Frist has handled this just fine, and we got 'em right where we want 'em. Granted the Rats will do damage, but they'll do that anyway. The key is make the cost as high as possible.

Really tipped his hand there. All this talk by the Dems over how another 'moderate' needs to be nominated to replace SDO implicitly acknowledges that the court is politicized, perhaps irrevocably.

I don't think they would filibuster Gonzales. The Democrats would let him through to show they are "reasonable" and then filibuster the next candidate.

Fine, but no more of these "virtual filibusters". Make the rats do the real thing. Make them shut down the senate by talking non-stop. Make every single one of them stay on the senate floor. Bring in the cots and the sleeping bags.

I'm sick and tired of the dems waving a finger and saying "oh, we'll filibuster that" and the republicans giving up without the dems having to put any effort into it at all.
