Does anyone have a quote from O'Conner, Kennedy, Suter that they have said there is a basic human right to be be free?
A textualist like Scalia would also be acceptible, although I would prefer an originalist like Thomas. It is a distinction with enough difference that it is worth noting, although I think Rush uses the terms interchangably.
