Conspiracy theory: Maybe Time and the NYT don't want it revealed who actually "may" have leaked the info - - if anyone in the Bush administration did. Both Time and the NYT would PREFER to have people think it was Karl Rove. So if they have their reporters go to jail, that is what happens. Whereas if they testify that Karl Rove never told them anything like that, liberals would be bummed out.

I remember all the gnashing of teeth over the supposed "crime" of outing a CIA operative. This seems to have been a well planned "crime".
