Senate Judiciary Committee Chairman Arlen Specter (R-Pa.) complicated the already dizzying calculus about the future of the Supreme Court by speculating at length yesterday about the possibility that Justice Sandra Day O'Connor would stay if President Bush elevated her to chief justice.
Most Republican officials interviewed this weekend said they expect Chief Justice William H. Rehnquist to announce his resignation soon, although they said they had no hard evidence of that. Specter said on CBS's "Face the Nation" that his "own analysis is that the chief does not intend to step down as long as his health holds up." But then he all but endorsed the idea that O'Connor, whose swing vote has both vexed and pleased conservatives, would be a shrewd choice for chief.
"I think it would be very tempting if the president said to Justice O'Connor, 'You could help the country now,' " Specter said. "She has received so much adulation that a confirmation proceeding would be more like a coronation, and she might be willing to stay on for a year or so." The chairman said he had heard "senators who had made that suggestion to Justice O'Connor, and that the response that I heard was that she said she was flattered -- that she didn't say no."
Specter, cognizant of conservatives' wariness of his moderate views, added: "I don't want to jinx it. If I say it's a good idea, there's going to be an upsurge across the country against it."

Lets appoint the retiring O'Connor to a vacancy that doesn't yet exist!
This might make sense when one follows strict adherence to Scottish law, but to me it makes no sense at all is just more blather from Specter.
Can't someone gag Arlen? He is an embarrassment.

Arlen Specter? Wasn't he the liberal defense lawyer for the murderer Ira Einhorn? If I recall....Bush supported Specter over the Conservative candidate (Toomey) in the Penn. primary race for the senate seat Specter now holds.

Bush made it a policy to endorse all GOP incumbents, which is fine in and of itself.
However if he didn't aggressively campaign on Specter's behalf and enlist Santorum's help, there's no way Specter would have won the primary.
God hope that Sphincter is not a front man for Bush on this DISGUSTING plan! This would be the worst!
O'Connor probably has been reading all the columns canonizing her as "the Savior of American women by her swing votes" and "the most powerful woman in America."
She could last another 7 years on the court at least--her health is not an issue. It was because of her husband's health that she announced she would step down. O'Connor's retirement started a panic among liberals. Perhaps this is just wishful thinking on the part of Arlen, and the New York Times as well. Perhaps, also, they have asked her about this possibility.
No matter. She was a crummy justice for the most part. Good riddance to her.
Not that I think for a moment that the R's have the stones to do it, but Specter needs to lose his chairmanship -- NOW! We couldn't be any worse off if he were to step down from his senate seat and be replaced by a Rendell-appointed Dimwit.

Oh yeah, that's just what we need: a coronation on the Supreme Court.
Of one thing we can all be sure: Specter will find some way to betray the trust his colleagues have given him. He wanted to be chairman of the Judiciary Committee for a reason - to ensure the court remains liberal.
I asked her and she didn't say no.
