CHICAGO - A young Marine who feared returning to Iraq persuaded his cousin to shoot him in the leg, then told police he was hit by random gang gunfire, authorities said.
The shooting early Saturday was meant to keep 19-year-old Moises Hernandez from going back to Iraq, prosecutors said.
He was charged with filing a false police report. His cousin, Juan Hernandez, 19, faces a felony weapons charge.

I wonder why this COWARD even enlisted in the Marines?? They should throw him out.
I hope they do. Coward is EXACTLY what he is!
I can't get to the article from here...can you hint as how they were caught?
I think the UCMJ covers malingering.
So Juan would prefer to definitely be shot (by his cousin) instead of taking the chance to be shot in Iraq? I think it is better that this guy did not go over.
'Whatever he experienced changed him totally,' the senior Hernandez said."

If he's that willing to take a bullet, something tells me he's going to take many, many more in the years ahead as he'll become the poster boy on firing range targets from sea to shining sea.
There are a couple of million Iraqis who would have shot him. Why get his cousin in trouble?
He should have asked me to shoot him.
As well as distruction of government property. Actually, I've seen that happen. An Airman when I was stationed in Montana kept getting bad sunburns from laying out and couldn't work, so finally, they busted him for just that, as well as malingering.
Imagine if he had somehow died from that gunshot. That would've been perfect for a Darwin Award.
A lifetime ago I was a medic in a base dispensary. I believe that sunburn was "generally" deemed Line of Duty/No.
Doesn't say but I would assume that since he claimed it was random gun fire from rival gangs, I bet you the police questioned people around the neighborhood and found out there was no gun fire at the time they said there was.
The Corps is well rid of this one.
I hope his cousin enjoys playing hard-to-get at the prison prom.
Thanks!
Not much more info on this. On another website it says he joined the marines to get away from gang violence. What a jerk! He should have stayed in the gang - he would have gotten shot sooner!
Marines 'fight' the enemy for each other to protect their buddies when ordered for a mission. To leave a fellow Marine behind dead or wounded really bothers them even more. It is a good thing this particular Marine did what he did to himself to avoid fulfilling his oath. I would not want him on my 6 in a tough battle.
He now has no honor as a Marine or soldier and does not deserve to wear that uniform any longer. He's simply just one of those humans that can't 'hack it' and needs to be discharged and place under therapy.
Once a Marine, always a Marine.
