CIA Referral Did Not Mention Intelligence Identities Protection Act

According to a source. This interesting note is buried in the last paragraph of the Newsweek story:

Leak Investigation: The Russert Deal—What It Reveals

Fitzgerald has been said to be investigating whether any aides violated the 1982 Intelligence Identities Protection Act—which makes it a felony to disclose the identity of a covert CIA employee: it requires showing the violator knew the agent's undercover status. (The State memo makes no reference to that.) But the CIA's initial "crimes report" to the Justice Department requesting the leak probe never mentioned that law, says a former government official who requested anonymity because of the confidential material involved. Fitzgerald may be looking at other laws barring the disclosure of classified info or the possibility that current or former White House aides made false statements or obstructed justice.

So what exactly was Fitzgerald tasked to investigate? And why has the media lied about this for so long?

You don't think it is interesting that the CIA didn't request a Justice Department investigation into the leak of a covert agent's ID?

That everything we've been told for three years about this case might not be quite true?

That puts a speedbump in one of my theories that the CIA misrepresented the nature of Plame's "covert" status. Perhaps this means that the CIA merely wanted the SP to look into the leak of confidential information (Espionage Act).

He was tasked to create an investigation and hope that somebody would either lie or make a mis-statement during that investigation so that he could charge them with "lying to a federal official".

How is that?

It sure does.

The left (media) have argued that of course Plame must have been a covert agent. Why else would they have turned this over to the Justice Department to investigate?

The reason for this investigation has ceased to exist, and thus if Fitzgerald was truly non partisan, he would shut down. The fact that he hasn't proves that he has an agenda, and that agenda is to indict Rove, Libby, Bolton, and maybe Cheney. Gonzales should fire him and/or Congress should pull his funding. When is our side going to start playing hardball? This is all out war and we had better realize it.

Yes. I recall reading somewhere, quite a number per week.

This was jumped on by the media, who decided to insist on a special prosecutor.

I think that's wishful thinking. Fitzgerald wouldn't be spending all this time and effort just going after the Wilsons. He's out of control.

I wouldn't say that. First of all, I'm not sure what the reason for the investigation was in the first place. How can I conclude that reason has ceased to exist?

I recall at the time the referral was made to the DOJ a spokesman stated that there are roughly one or two such referrals a week. It is routine for the CIA to make such referrals. This one has juice only because the press wants to get Rove.
