Attempt to criminalize free speech fails

Jim Kouri

August 1, 2005

With so much violent crime in America, and a serious terrorist threat with which to contend, the leaders of the Democrat National Committee decided to crack down on criminal behavior: they filed charges with the Federal Election Commission against television stations that dared to air a documentary considered harmful to their candidate for President of the United States during the 2004 election cycle.

The DNC filed charges against Sinclair Broadcast Group, their news commentator Mark Hyman, and one of Sinclair's vice presidents, Frederick Smith, alleging they violated FEC regulations. The complaint filed with the FEC was related to a documentary, "Stolen Honor," critical of John Kerry's service in Vietnam.

The documentary also showcased Senator Kerry's anti-war activities including his unsubstantiated claims of military atrocities committed in Vietnam. Sinclair aired portions of the documentary last October as part of a news special. A complaint was also filed by an individual in Cedar Rapids, Iowa, relating to commentaries by Mark Hyman that editorialized about Mr. Kerry. Sinclair contended they did not violate the federal election campaign act.

In a unanimous vote, all six of the FEC Commissioners agreed that Sinclair, Mr. Hyman and Mr. Smith did not violate any campaign finance laws and that their broadcast activities were protected by the "press exemption." All charges against the broadcasters were summarily dismissed. Apparently the DNC leadership believes the First Amendment does not apply to conservatives and the Republican Party.

Sinclair Broadcast Group, one of the largest and most diversified television broadcasting companies, will own and operate, program or provide sales services to 61 television stations in 38 markets, after pending transactions. Sinclair's television group includes FOX, WB, ABC, CBS, NBC, and UPN affiliates and reaches about 25 percent of all US television households.

No stranger to controversy, Sinclair's award-winning commentator, Mark Hyman, recently appeared on Fox News Channel's "The O'Reilly Factor," where he discussed his commentary calling for the resignation of Linda Foley, President of the Newspaper Guild of America (NGOA).

Jennifer Gladstone of Sinclair's NewsCentral provided an exclusive report on the NGOA's allegation that the US military has been targeting journalists in Iraq — a charge that the US military emphatically denies.

When asked to substantiate her allegations that the military are attempting to assassinate journalists, Foley refused to comment. The DNC also remained silent regarding Ms. Foley's accusations. Also peculiar — although not surprising — is the mainstream news media's silence on the Sinclair case and its outcome.

This action by the DNC gives us some insight as to how life would be under a Democratic controlled administration. It wouldn't be a repeat of 1992-it would look more like 1984.

The left will have their silence, as one after another of their media organs die off or are relegated to irrelevancy.

Meanwhile the web and the talkies and the satellite networks flourish and expand at a near terrifying rate.

The Rats philosophy of entering an arguement with a lawyer in tow hasn't reaped many benefits for them. It has given us good laughs.

This doesn't really matter. The DNC kept "Stolen Honor" from being show before the election. Their threats got Sinclair to run a gutted version of the program.

California or Massachusetts are in microcosm what we should expect to see from the Democrats.

Has there ever been an estaqblsihed socialist government that was not removed by external force or pressure?

A Socialist USA is nightmarish for just this reason: No one will be there to free us.

Kerry has also filed suit against the film's producer. The plaintiff is a guy seen on the film apparently coaching a Vietnam vet faker to "remember a massacre" that did not occur.

By attempting to silence the opposition, they are only making their message even more visible than before.

While the FEC didn't rule in the Democrats' favor, the Democrats didn't exactly fail, they had successfully intimidated Sinclair Broadcasting, and advertisers, so that the broadcast was so watered down that I couldn't even watch the whole thing. The same stations broadcast network news pro-Democrat propaganda for months, and the networks and affiliated stations felt free to ignore any complaints. The left is much better at organized activism (and bulling) than we are.

Thats why we have the 2nd amendment to protect us, not against criminals (like those in academia and the MSM would like you to believe), rather, against an oppressive government.

This was the issue that got George W. Bush my vote. More to the point, it was the issue that got me to vote against John Kerry.

I was thinking about voting Libertarian, but shortly before the election when Kerry goon Chad Clanton said of Sinclair Broadcasting that "they would regret" showing an anti-Kerry documentary and that "they better hope we don't win the election" I knew I could not take a chance on Kerry winning, and voted for Bush.

The market economy is "pressure", but Yes. Socialism and communism simply collapse of their own inertia, as those who they live off of flee their control before they react. The leftists who would rule are innately lazy and corrupt, those they seek to rule are innately clever and fast movers.

In America we have 50 states and mobility. As is happening here (massachusets) the productive eventually flee. Soon all that will be left here are government workers, university employees, lawyers and illegal immigrants.

There is a house for sale on every street here, soon this one too.

When did it happen that Socialism fell from internal pressures? It was the Cold War that brought the USSR to an end.
