CHP Revises Policy on Pot Seizures(Free pass for tokers)

The California Highway Patrol has ordered its officers to stop confiscating medical marijuana during routine traffic stops, a victory for patients hoping to win broader acceptance of the controversial medicine from balky police departments around the state.

Highway Patrol officials sent out a bulletin last week to field commanders spelling out the policy shift, which would allow patients to travel on California's highways with up to 8 ounces of marijuana as long as they have a certified user identification card or documented physician's approval.

For the last fiscal year, ending in July, Americans for Safe Access collected reports from 457 patients and caregivers who were arrested or had their medical marijuana seized by police officers in California.

About a quarter of those cases involved the Highway Patrol, and the rest were spread among police and sheriff's departments in 48 of California's 58 counties.

The Oakland-based patient group sued the CHP and Gov. Arnold Schwarzenegger in February, asking the Highway Patrol to alter its confiscation protocols for medical marijuana. Activists said CHP officers would seize even the smallest amounts and sometimes arrest patients after they presented documentation from a physician.

I wouldn't mind if the CHP would refocus their resources on extraditing illegal immigrants.

That's a lot of weed. Refill the prescription when it's down to 4 ounces?

i've been thinking about this for awhile.
since they say that State/Local LEO's can't enforce Federal laws on illegal aliens... then don't enforce ANY FEDERAL LAWS!!! except for the co-statutes of murder/rape/robbery/arson. then see how they like it.

I think any open intoxicants found in a motor vehicle should be an automatic revocation of driving privileges.

Assuming that your post referred to reducing the reach of the fed.s reach into controlling personal liberties - the use of marijuana in particular - and in direct response to your remark "that's Selective Enforcement and i don't believe it's legal... all or none." :

The writers of our constitution knew that they weren't producing a perfect model of government thus their writing "to form a more perfect union" - Well, we still don't have the ability to create a perfect union and must modify our rules of conduct as we go.

The writers of the constitution did include one brilliant and often abused concept - that of states rights and limited federal government - at least that is what they tried very hard to leave. Some where in the forming of our republic style government it is mentioned that this is a grand experiment. It is that - but not now or ever will be - perfect.
