Eliminate the Due Process Clause of the 14th amendment and you'll know what I mean.

I already know what you mean, I just don't agree with it.

State constitutions and state laws prevail unless superceded by constitutional federal law. That is what the Founding Fathers had in mind when they wrote the Constitution and established federalism.

There we need a little clarification. What exactly do you mean by "constitutional law". Is it whatever the Supreme Court says it is, reagardless of whatever penumbras and emanations they find to base it on? Or is it law that is objectively defensible as being within the original intent of the Founders, based on their supporting writings? I go by the second one. What say you?

I know that makes a centrist like yourself uncomfortable. You'd like one set of laws, one set of protected rights, and you get to interpret what they all mean for every American.

"Centrist"? Meaningless drivel. Center of what?

Furthermore, I don't "get" to interpret anything. All I can do is examine the available evidence and follow where it leads, making a conscious effort to set aside my own preconceptions about what the words of the Constitution mean.

I believe all conservatives would agree that you cannot correctly interpret the Constitution unless you assume the words and phrases to have the meanings and intent held by those who wrote it.

Quote me any Founding Father that said that was the goal.

The abuse is laughable.

The existing system for regulating medicines would probably work better ... too bed the feds won't let any state use it for medical marijuana.

Who's wringing their hands? I think the idea here is to vote only for candidates who will get originalist judges into office.

Because it defines them as a drug dealer/drug trafficker -- someone we don't like.

In a few words or a lot of words - What is it about someone growing some cannabis, curing it and ingesting it that bothers you so much?

It happens all the time and I am sorry that you are bothered by people who choose to use cannabis, although there are many other activities citizens do that have got to bother you much worse.

In California, the cultivation or processing of any amount of marijuana is a felony and punishable by up to sixteen months in state prison.

What do you think of my cost analysis?

It looks like California government is wasting lots of tax payers monies -and- putting the population at risk by -wasting- jail space on persons who are not harming the citizens of the state. I am sure there are violators of life and property laws who have to be released early because of lack of bed space in California prisons. Poor governance - time to decriminalize the cultivation and use of marijuana.

He and the other sworn California state officials should be arrested and tried for sedition, if not treason, for violating their oath of office to honor the U.S. Constitution.

I haven't seen such a WAAAAAAMBULANCE whine since... well, since the last time I trolled DU.

You really ought to try it; your government-supremist viewpoint will be much more welcome there.
