I don't see why this would trigger a fillibuster of Roberts. what the Dems will do is try and delay Roberts, and will ask for the 2nd Justice to be named before the vote on Roberts, so they can get a "package deal". Bush must resist that.
Its going to be a wild political season now for sure. Wild.
Politics aside, prayers for Rehnquist - he fought so long, and I am sure he was fighting to stay alive until Roberts was confirmed.
Yeah, they'll do all that. They'll also try to persuade O'Connor to withdraw her retirement and take the Chief Justice position.
But if all else fails, they will filibuster.
