Right now the President has the support of sane people who know where the failures and those responsible lie in this mess.

Had he authorized the Goverment to overtake a State of the South we'd all be raising cain right now.

I have information that the National Guard was stopped outside Lousiana for eight hours while the White House attorney's negotiated with Blanco's attorneys over who would be in charge.

That might explain the gag order she put on the NG

as it should be.<

Except when it is right that it should not be. It sort of reminds me of when a famous bridge player was asked when you should lead the queen in a certain kind of hand. His answer: when it's right. I am a fact specific guy. Grand theories don't animate me much.

The Insurrection Act (Title 10 USC, Sections 331-335). This act allows the president to use U.S. military personnel at the request of a state legislature or governor to suppress insurrections. It also allows the president to use federal troops to enforce federal laws when rebellion against the authority of the U.S. makes it impracticable to enforce the laws of the U.S. Assistance in the case of crimes involving nuclear materials (Title 18 USC, Section 831).

This statute permits DoD personnel to assist the Justice Department in enforcing prohibitions regarding nuclear materials, when the attorney general and the secretary of defense jointly determine that an “emergency situation” exists that poses a serious threat to U.S. interests and is beyond the capability of civilian law enforcement agencies. Emergency situations involving chemical or biological weapons of mass destruction (Title 10 USC, Section 382). When the attorney general and the secretary of defense jointly determine that an “emergency situation” exists that poses a serious threat to U.S. interests and is beyond the capability of civilian law enforcement agencies. DoD personnel may assist the Justice Department in enforcing prohibitions regarding biological or chemical weapons of mass destruction. Military support to civilian law enforcement is carried out in strict compliance with the Constitution and U.S. laws and under the direction of the president and secretary of defense.

My real concern is before the storm.

I know.. The buses, the ambulances, even cattle cars to get the people out of the city when all indications were that the city was about to be swamped.

It would have been overturned by the courts before Bush's pen left the paper. The levee break would absolutely have been claimed to be a plot by the CIA to back up the president.

Our country has too many lawyers and way too much political polarization. We don't discuss things, we argue them. And typically it is argued from the stance of 'do it our way or else' and usually that is on the liberal side, though we do it too.

Thousands paid with their lives for this, and instead of everyone taking a deep breath, they're coming up with every moonbat theory possible. Dumb. Thankfully most everyone has seen through it and understands, but still the insanity holds back the hand of help.

Which state's units? Where were they located before they came into Louisiana? What was the date?

We know that they entered under Blanco's control.

Yeah, I forgot. Now how does the left put that together? He acts like Hitler but doesn't take over three states during a hurricaine. Oh, I get it. the left thinks he is a dumb Hitler. God, Liberalism is really a mental disease. for openers, they are not rational.

Tonite Ann Coulter was arguing with Colmbs on Hannity about blaming Bush for the Hurricaine...and suddenly, Colmbs changes the topic to Iraq..huh? Everytime, the Libs have a discussion, they change the topic or the parameters of the discussion.

The courts would have done nothing. It would have been litigated after the fact, maybe, not before. No court would issue an instant injunction when the president said there was a national emergency, and he needed to move to save lives, and if some rogue federal trial judge held otherwise, he would hve been instantly overturned, and the injuction dissolved. That happened in St. Louis when some federal judge held that the polls should be kept open for an extra three hours in St. Louis in 2000. That ruling was overturned by an appellate court in one hour.

I think the whole attack on Bush is so the Left can avoid the reality of failure by Nagin and Blanko and the whole DEm machine. then, like on CNN tonite the mantra is "Oh, gosh, there is just enough blame for everyone to go around"...typical "realtivism" of the liberal!

Drudge playing catchup agian..... this has been talked about for some time and here's a fairly detailed article about it.....

Bush, Blanco spar over military, visit

One flashpoint came over the weekend, when Blanco said she rebuffed an attempt by the White House to seize control of the mounting military presence in Louisiana, including thousands of state National Guard forces under her authority. Then Bush made an unusual return visit to the state Monday, just days after surveying the damage - a trip that members of Blanco's staff said caught them by surprise and caused a certain level of consternation.

Friday night, the White House moved to take charge of all the troops in Louisiana. At home, Blanco received a memorandum of understanding from the White House asking her to cede control of the National Guard. According to her staff, Blanco was asked to sign and return the document right away. Blanco consulted with her legal counsel, Terry Ryder, and then refused the request.

"They wanted to take over my National Guard," Blanco said in an interview. "A governor has to have the final say on what's going to happen."

[end snips]

The more I think about this, the more obvious it is that Bush would have made a monstrous mistake if he had tried to take over the state.

Either he would have had to completely remove the governor from power, and throw her into a holding cell somewhere, or he would have had to deal with two competing chains of command, with the media throwing up a firestorm of propaganda and the Democrats in the senate throwing tantrum after tantrum and refusing to conduct any business.

It would have been a disaster. No, the people of Louisiana have to live with the folks they elected, or rise up and force them to resign. There's no way that Bush can step in and declare martial law, or anything of the kind. It would be a terrible precedent and a terrible mistake.

I absolutely agree!

As inept as LA appears to be, I don't think anyone in the State was in insurrection nor do I believe State authorities were failing or refusing to enforce the laws of the United States.

Now, if LA had significant areas in rebellion, or was violating Civil Rights or refusing to abide by the laws of the US, wael, that would have been a whole different story.  Send in the Militia of the United States!

Perhaps you should read the Constitution and the Federalist Papers.

Or find another country to live in.
