Court allows ‘dirty bomb’ suspect to be held

RICHMOND, Va. - A federal appeals court Friday sided with the Bush administration and reversed a judge's order that the government either charge or free “dirty bomb” suspect Jose Padilla.

The three-judge panel of the 4th U.S. Circuit Court of Appeals ruled unanimously that the president has the authority to detain a U.S. citizen closely associated with al-Qaida.

“The exceedingly important question before us is whether the President of the United States possesses the authority to detain militarily a citizen of this country who is closely associated with al Qaeda, an entity with which the United States is at war,” Judge Michael Luttig wrote. “We conclude that the President does possess such authority.” ...

Luttig, who has been mentioned as a possible candidate for the U.S. Supreme Court, was joined in his opinion by Judges M. Blane Michael and William B. Traxler Jr.

this is a big win.

but the administration needs to followup now - Padilla cannot be held indefinitely, this should clear the way to give him the legal due process he deserves - a military tribunal, followed by a firing squad.

I have a real problem with this -- not from a "civil rights" standpoint, but because I utterly distrust government in so many ways.

In light of that charade we called the "9/11 Commission" and Mr. Padilla's striking similarity to those sketches of John Doe #2 in the Oklahoma City bombing, I strongly suspect that the government's primary motive in treating Padilla as an "enemy combatant" has nothing to do with national security and everything to do with keeping all information about his past out of the public eye.

Yes, but this is not a libertarian country, It is a Republic, and our constitution is not a Suicide Pact.

This guy is an enemy soldier, (which is clearly stated int the judges ruleing) and since the Judge agreed that we are at war with Al Queda, it also opens the door for Treason charges.

Enemy soldiers are not common crooks to be handled by criminal courts.

I disagree that there is a striking similarity.

The chin is nothing like the sketch. There was 8 or 9 years separating the sketch and the photo. Padilla was about 22 at the time of OK-City, Padilla would not have gotten younger looking.

Maybe so. But their eyes look nearly identical.

One thing you have to do is ignore the hair -- the original sketch included a hat on the guy's head, so they modified his head based on what they thought his hair looked like.

One thing that makes me extremely suspicious about this John Doe #2 is the way the FBI posted this sketch all over the place, only to decide later that he didn't exist.

As a follow up to this ruling, "W" needs to work his way back through the judiciary and pick up the judge who issued a ruling to let Jose loose, as well as Jose's lawyers, and the Freeper Libertarians who advocated on behalf of this nonsense.

They are ALL entirely too closely related to AlQaida for my comfort.

Judge should order the dude be remanded into custody of The New York Times. Then, Krugman, Friedman (who's afraid of his liberal wife), Dowd, racist Herbert and the rest of the crew can take care of him.

And remember, per Judge Lefkow from Chicago, it's WRONG to criticize the decisions of judges. They're always right!
