Let me ask you, you go to a chaotic crime scene, their is a guy with his head blown off (#1) and a dead woman (#2) too. The wits all say subject #3 shot #1. How do you know #3 was not connected or somehow related to with #1 and or #2 until you conduct an investigation? What the wits say they saw, and what actually occurred *prior* to the event can be two completely different things.

I suppose it all depends on the situation and requires a rational judgment. Fine. Automatically cuffing someone, even thou you have respected eyewitnesses all telling the same story, and the hero handed over the weapon used, no problem, is just a zero thinking response.

I saw some cops doing a click-it-or tickett thing, pulling out with out using turn signals (Like the law was meant for everyone) and approach the car like the the driver was the felon, (Kind of ironic because the driver was about to be robbed - well legally robbed that is.). Now you can say the law was meant for everyone, and the driver should of had his seat belt on, but if these cops really gave a damn about enforcing the law, you think they would of wrote some tickets for failing to signal. Oh yeah, the law was not meant for them. My point here is they automatically assume the citizen is the felon, after the citizen stops a killer, or even when they are about to rob the citizen themselves.

Common sense tells me that there's not much comparison between a kid with a plastic fork and an adult with a handgun near a dead body.

Right you are. They are different situations. Was there a zero tolerance - zero thinking response in both situations?

You wrote:
"and do a cursive investigation"

For some reason, I don't think handwriting analysis is relevant to this crime. I may be wrong.
You meant to say "cursory," meaning hastily or superficially performed. Cursive is a handwriting style.

If I had been that citizen, I'd fully expect to be disarmed and restrained until the cop had a chance to do his job.

Finally, some common sense.

This act most certainly prevented another crime from being committed, likely a whole group of other crimes.

I found this reply on another thread. It sounds legit, so I wanted to post it here.

My husband, Shawn, says he is not a hero, just a citizen willing to help his fellow man, or woman, in this case. He believes that at least half the men he knows would do the same thing in such a situation. He has suffered tremendously because of this horrific tragedy, which he endured and witnessed and says, "I never thought I'd have to use that gun." God knows, he and I both, as well as the victim's family, wish to God he had not had to -- we all wish the entire situation had never occurred. If only Kimberly had lived, I think Shawn would feel better about the ordeal. Shawn says he is not a victim, but after what he has been through emotionally, I believe that he, too, is a victim of the horrid crime perpetrated by Brian Clark.

And just to set the record straight, the perpetrator did fire a shot at my husband, Shawn, and, luckily, missed. So, by all means, his life, as well as those around the area was in serious danger. And Georgia law states that a citizen has the right to use deadly force to protect himself and the others around him. Which is exactly what Shawn did. He is not going to suffer any legal ramifications, but will take a lot of time to recover emotionally from what happened. He is a very clear thinker in bad situations, and a very good shot (just from playing with his BB gun, as a child, and having a God-given talent of tremendous hand-eye coordination), but I still ask that you all pray for his peace of mind.

Also, at the time Shawn was following the car, he had no idea it was a carjacking. He thought it was domestic violence between a husband and wife. It was only after the perpetrator emerged from the vehicle with a gun did Shawn realize what was going on. He then armed himself, thinking the man would drop his weapon. Instead, it was only after the perpetrator raised his gun at Shawn, that Shawn was forced to shoot this man.

In any event, thank you so much for your continued support. Even though he is very modest about this whole "hero" thing, in my heart, I do believe he is a hero and could not be more proud of him for trying to save Kimberly's life, even at he risk of losing his own. What a wonderful man he is -- a great husband, a great father, a wonderfully smart business owner, and a moral man who is willing to stand up for what is right no matter what the risk.

It is time for some public hangings. When are we going to have real leadership? How sad that a citizen has to take care of business like that. Poor woman and her family.
