FEC Sues Pro-GOP Group

Federal election officials on Monday sued a pro-Republican political group to try to force it to comply with campaign finance limits, the first lawsuit of its kind to arise from big-money fundraising during the 2004 elections.

The Federal Election Commission filed a complaint in U.S. District Court in Washington against the Club for Growth. The group spent at least $21 million in the 2003-04 election cycle.

The FEC contends the group spent enough in federal races to require it to file with the commission as a political committee and to abide by contribution and spending limits.

A Club for Growth spokesman did not immediately respond to a message left at his office seeking comment.

FEC Vice Chairman Michael Toner called the case "one of the most important suits the commission has brought in recent years." The lawsuit is the first to result from several complaints filed against both pro-Republican and pro-Democratic "soft money groups," and could serve as a test case to see if the commission can control the groups without new congressional legislation or FEC rules.

Campaign finance watchdogs contend the groups spent millions of dollars in corporate, union and unlimited contributions from individuals in the 2004 election despite a new law banning the use of such money in presidential and congressional races.

"At stake is whether Club for Growth will be able to continue raising and spending millions of dollars in soft money for activities influencing federal elections," said Toner, a Republican.

President Bush's re-election campaign and the sponsors of the 2002 campaign finance law sued the FEC last year, accusing it of failing to enforce the law and crack down on soft money spending, particularly in the presidential race. Those cases are pending in federal court.

The commission's lawsuit against the Club for Growth accuses the group of failing to comply with federal fundraising and spending rules as far back as 2000.

The complaint says the group told prospective donors their money would be used to help elect or defeat specific candidates, and that it raised more than $4 million last year alone that exceeded federal contribution limits.

The group spent more than $1 million in the past three elections on ads targeting specific campaigns, often going so far as urging voters to elect or defeat candidates, the lawsuit says.

As far as I'm concerned the law is blatantly unconstitutional, and since it's now obvious that it will only be applied to conservatives, I hope the Club for Growth fights this all the way to the Supreme Court and gets the law thrown out.

Unbelievable. Left wing groups out the ying-yang during the last election cycle throwing around 10's of millions of dollars every which way and a Conservative group is sued.

It may be CYA to enable them to go after MoveON, etc.; although, I'm somewhat surprised they didn't go after the Swift Boat Vets first. Nevertheless, I still think the whole law is BS and needs to be overturned. Anybody should be allowed to spend whatever they want in advertising for elections, it's clearly covered as free speech and freedom of the press.

I would bet anything that if CFR remains, it's only a matter of time before they go after Free Republic.

The law sure is unconstitutional. I think the Club For Growth has been successful far beyond what any lib imagined, so now they feel they have to stop them. I'm sure they will fight this to the end.

It's time to go after the Federal Elections Commission. They are a pregnant symbol of fascism and have no business in America's political life.

This is yet another of many reasons that the Supreme Court nominations are so important. O'Connor co-wrote (with Stevens) the opinion upholding McCain-Feingold.

Assuming it takes two to three years, we may actually have three or even four new justices. Stevens is quite old and Ginsburg has had some health problems.

There are currently three votes on SCOTUS that would throw out any if not all campaign finance law restrictions on money they are Scalia, Thomas, and Anthony Kennedy. I pray that after Roberts and the next one, we will have 5.

Actually I suspect Roberts would uphold the 70's regs from "Buckley v. Valejo" but might reverse McConnell v. FEC aka McStrange-Feingold.

If this makes it to the D.C. Circuit court I hope Janice Rogers Brown is on the 3 judge panel.

There is also the disturbing possibility that "moderate" Republicans have a burr up their behind for the Club. If I am nit mistaken, the Club has endorsed some conservative candidates over "moderate" (liberal) Republican incumbents. I really hope that it isn't some RINOs behind this.

Isn't this exactly the sort of biased prosecution of the campaign finance law that was predicted before passage?

I fully expect pro-liberal/DemocRAT groups to also show up on the docket.... OK, so I won't hold my breath.
