Right, but we're not going anywhere burning chemicals. Right now there's no (acceptably) safe means of getting nuclear materials into space.

Aha! Perhaps this consideration will clarify.

The US Senate Committee on Energy and natural Resources is aware that: "Without defined legal status, few if any companies would be willing to invest the significant money required to extract and utilize space resources."

Also, the President's Commission on Moon, Mars and Beyond reached the same conclusion.

Not only is the 1967 Treaty in the way, but there is no mechanism to claim space resources. Since the two driving factors of modern business are linked: credit and proprietary processes, deeds, etc., the credit is not forthcoming without deeds. Proprietary processes are available, but the paper is not. No credit, no space development.
