§ 251.004. VENUE. (a) Venue for a criminal offense prescribed by this title is in the county of residence of the defendant, unless the defendant is not a Texas resident, in which case venue is in Travis County.
DeLay's residence is in Fort Bend County (Sugar Land), not Travis County (Austin).

They came on in droves this afternoon to point out that Ronnie Earle has indicted both dims and repubs. After reading some of Earle's speeches I think he can be more correctly characterized as a Marxist. He hates every corporation he has ever heard of, until he can extort them.

Given the statute, its reasonable to surmise DeLay's attoneys can get the case transferred to Fort Bend County whose D.A will make the decision as whether or not to proceed with the indictment.
