It's black bear season,with the leaves still on the trees I can see it happening.
From the reports I read, he was squirrel hunting with a 22. You have to sight your target and take careful aim to get any game. This was no accident. Especially multiple shots.
IMHO this bastard should be tied to the tree and left to die on his own.
