Who published that analysis? Cite or link if you are able. I'd heard only that she advocated the ABA develop a postion on the issue with the benefit of full member vote instead of a leadership developed action. There is a reasonable chance that, if the entire ABA voted, the position would have been practically the same as it is now stated.

Miers may be a fine woman and a good pick for an appeals court, but this is the Supreme Court. This is the Big Time. There's only 9 SCOTUS Justices in all the land. No matter what, Bush could have done better. We were expecting another homerun like Roberts, and instead Bush decided to bunt.

Well said. Some simple facts regarding this pick are:

A) President Bush said he wants to appoint SC judges in the Scalia mold. I believe he is an honest man, and I take him at his word;

B) President Bush has worked closely with HM for a number of years, and I daresay knows her mind better than any Democrat or pundit;

C) President Bush does not need to choose a nominee just because his/her name is well-known in Conservative circles - it's the results that matter; the steak, if you will, not the sizzle;

D) HM's nomination may be designed to preempt a vicious Senate battle, and while I am just as ready to roll up my sleeves and go get 'em as the next guy, the President may recognize the wisdom of disarming his foes by taking away their most vicious weapon, i.e. their ability to demonize, with the help of a compliant media, any high-profile nominee in the Luttig mold, while at the same time painting the entire administration with an extremist brush.

This has the potential to be a wickedly clever move. It looks moderate and centrist, but (and I hate to beat this word to death) may well be a stealth pick. It may be a Trojan Horse for which the Dems will open the gates, as they misread it to be a peace offering.

One more thing; I think it may be possible to be pro-choice and anti-Roe. Send the matter back to the states, where it belongs.

You succeed in those types of environments by being a pragmatist, a compromiser, a go along to get along.

You are correct, unfortunately. To be conservative in the traditional sense (strict construction of the Constitution, pro-free market, limited government, balanced budget, opposition to feminism, "gay" rights, abortion, and other anti-family positions, firm adherence to Judeo-Christian morality, etc.) is to be revolutionary in the present political environment. Calvin Coolidge, Robert Taft, Sr., and Barry Goldwater would be fringe characters in the 21st Century Republican Party.

The ghost of Nelson Rockefeller has had the last laugh. The selection of Harriet Miers as an associate justice of the Supreme Court is evidence of the ideology and practice of the GOP. No spin on the part of Bush apologists can make this sow's ear into a silk purse.

I missed the original Terri Schiavo comment, but I've seen nearly a dozen complaints that someone dared to mention her name.

I don't know why Terri isn't relevant to this thread. We need justices who stand up for the basic constitutional rights to life and liberty. We need justices who will reverse the judicial tyranny that has brought unlimited abortion and judicial murder to our country. These are fundamental issues.

If Miers is not reliable on these issues, then this is a deal breaker for me and for millions of Christian conservatives who voted Republican in the last couple of elections.
