President taps Texan who's never been judge [Apparently Pre-Approved By Democrats]

President Bush today nominated a Texas lawyer who serves as White House counsel, Harriet Miers, to replace Justice Sandra Day O'Connor on the Supreme Court – a pick that apparently was pre-approved by Senate Democratic leadership.

In choosing Miers, Bush tapped a person who has never been a judge and therefore has no judicial record for opponents to criticize.

"She has devoted her life to the rule of law and the cause of justice," Bush said, announcing his choice from the Oval Office with Miers at his side. "She will be an outstanding addition to the Supreme Court of the United States."

Added the president: "She will strictly interpret our Constitution and laws. She will not legislate from the bench."

The Miers choice will likely be a disappointment to conservatives who hoped Bush would choose someone with a stronger "originalist" record.

"It looks like he flinched," commented Fox News analyst Bill Kristol. "It looks like a capitulation."

If she makes it out of the committee, it will be interesting to see how conservatives vote on her. Has there ever been a candidate that was not supported by their own party?

It breaks my heart to say this, but it looks like the President has more than "flinched"...it looks like he's completely lost his way.

...let's just hope the RATs "Bork" her good so Bush can opt for a Janice Rogers Brown. Then, again, I remember when Nixon offered up Carswell as a nominee and got turned down by the RATs his second choice, Haynesworth, also was rejected. However, he's got numbers on his side when Nixon didn't. Here's what kind of justice the RATs have in mind:

In June 1968, at the end of the 1967 Term of the Supreme Court, Chief Justice Earl Warren had Abe Fortas arrange an appointment at the White House, at which time Warren announced his retirement, effective upon the confirmation of his successor. On June 26, LBJ nominated Fortas as Chief Justice. To Fortas’s seat, LBJ nominated a friend from Texas, Homer Thornberry. In July, Fortas erred, appearing before the Senate Judiciary Committee despite the fact that no sitting Justice had ever done so. During those hearings, Fortas lied to the Committee, although he had not yet been caught in that lie. The Senate recessed without voting on the nomination. When Senator Robert Griffin learned in September that Fortas had accepted $15,000 to give some summer school lectures at American University’s law school, money that had been raised by Fortas’s former partners and clients, the nomination was in trouble. In early October, after a vote to end the filibuster on the nomination failed, Fortas asked that his nomination be withdrawn. By 1969, further revelations led Fortas to resign from the Court. A convicted financier named Louis Wolfson had agreed to pay Fortas $20,000 per year for the remainder of his life, an amount that continued until the death of his wife if Fortas died before she did. Fortas received the first check in January 1966, after joining the Court, and though he returned it in December, Fortas's actions were condemned as ethically improper.

With all the stuff from Republicans about not voting on a candidate because of ideology, they'd look a bit hypocritical not to vote for her. However, with the nomination of John Roberts, they can hold him up as the new standard.

I'm becoming more and more disappointed with Bush and the Republicans. They are not different from Democrats when it comes to spending. Socially, it seems they support legislation just for show to hang on to conservatives. How much actually gets enacted and not overturned by the courts? Now this, the only reason many people voted for Bush and Republicans. And I thought Dems were suicidal.

This proves it. Bush is no conservative. What he is is a gutless weasel! If he'd had any nads he would have nominated Janice Rogers Brown, but this slithering bag of moderate (liberal might be more accurate, based upon how he's grown the government) goo stabbed his supporters in the back AGAIN!!! I will NEVER , EVER vote for ANYONE named "Bush" again!
