LOL! Oh if you wanted to see real disaster, you just send me in to "fix" the stream! I have said it before, sys admins recoil in fear when I volunteer to "fix" anything in the data center. LOL!

Starting to breath again? HELLO Tony and Republicans! Conservatives have once again taken it in the shorts. They only need Conservatives for winning elections. 55 senators means nothing to the Republican Party, and this President betrayed a promise that he started making before the 2000 election. If Conservatives can't see this, we are as stupid as the DU Dummies.

Miers, the ABA, and the Federalist Society


Forget about Miers being a member of the Federalist Society. She seems to have been shocked that Society members didn’t like the liberal ABA:


Enter Harriet Miers, who has never been either a Federalist or a [conservative] movement woman. Before joining Team Bush in the mid-’90s, she worked her way up the legal ladder, mixing lucrative corporate law with traditional pro bono undertakings. Along the way, we now learn, she gave campaign contributions to various Democratic campaigns. That’s standard practice inside law firms, giving money to the powerful without regard to party. But that sort of get-along, go-along approach is exactly what the [conservative] movement reviles.

Moreover, what might seem to many to be among her qualifications - she was the first female elected to lead the bar association of Dallas and then of Texas - are to [conservative] movement folks mostly disqualifications, further proof that she is a tool of the despised status quo. But Miers has been oblivious to these ideological currents. An ex-White House lawyer told me that Miers was shocked to discover the lawyers in the White House counsel’s office were Federalist Society types, all of them scornful of the ABA - her ABA.



The Downside

The downside of President Bush’s nominations to the SCOTUS:


This week’s nomination of White House Counsel Harriet E. Miers, following Bush’s earlier selection of John G. Roberts Jr. as chief justice, means that the president has chosen two Supreme Court nominees with limited — or virtually no — public records on the key constitutional controversies dividing the parties. In the process, he’s bypassed a long list of judges with consistent conservative records on state and federal courts.

“I don’t know that there is a deliberate message — I think he is just trying to avoid trouble — but the message comes through: Do not be controversial, do not express strong opinions that arouse opposition,” said Robert H. Bork, the conservative legal scholar and former federal judge.



Bush, at a Tuesday news conference, sought to assure his supporters that Miers shared his conservative views and would remain steadfast to them.

“I know her well enough to be able to say that she’s not going to change, that 20 years from now she’ll be the same person, with the same philosophy, that she is today,” he said.

But Bush’s critics on the right maintain that his reluctance to nominate a known conservative for the Supreme Court sends a strong signal encouraging caution and consensus among conservative legal thinkers and judges.

“I suppose a lot of people are not going to want to join the Federalist Society,” said Bork, in a reference to a conservative legal group.

Since Bork’s Borking in 1987, there have been five Republican “stealth” nominees to the Court. Their record is mixed: Anthony Kennedy turned out to be a moderate conservative, David Souter is a reliable liberal, Clarence Thomas is a home run, and John Roberts and Harriet Miers have yet to reveal themselves.

When Republicans control 55 Senate seats, and 16 Democrat senators are from Red states, there’s no good reason to go with a “stealth” nominee. This was the right time to reward brilliant, outspoken, conservative jurists, and the president missed the opportunity.

What Good Is A Rubber Tree?

coverOn one of his voyages to the New World, Christopher Columbus came across a remarkable tree. It had round fruit that bounced like a ball. Its Indian name was caoutchouc—"the weeping wood."

The tree was given that name because it emitted a sap that looked like the tree's tears. Eventually, inventors discovered that the sap could be harvested and allowed to harden into an eraser that rubbed out pencil lead—hence the name "rubber."

In the 1830s it was found that rubber could withstand very cold temperatures when sulfur was added to it. This led the way to a huge demand for rubber when the automobile was invented. Later it was discovered that the sap could be used to make latex surgical gloves. The rubber tree had multiple uses that needed only to be discovered.

Likewise, when we consider the spiritual gifts taught in the Bible, we may find that we have more than one. If we try out new avenues of ministry, we may find that we have abilities previously unknown to us.

Whatever your spiritual gifts may be, they come to you from the Lord (1 Corinthians 12:4-6). What new ministry should you try out? You may discover a spiritual gift you never knew you had. —Dennis Fisher

My newest theory on Miers. Should I call Mr. Snow with it or is it too far fetched?

President Bush knew that the partial birth abortion case is scheduled for the court on Nov. 30. He needs his candidate confirmed and on the Court by that date.

If Bush went for the name candidates such as Owen, Brown, Luttig or Jones he was in for a big fight. Considering the RINOs said they wouldn't support a far right candidate (code= pro-life) Bush couldn't be sure the nominee would even be confirmed much less earlier than Nov. 30.

With Miers he might be trying to stack the court for some important social decisions coming up, including partial birth. Bush has called on her confirmation by Thanksgiving (Nov. 24).

President Bush will in all likelihood get at least one more pick (almost had it the other day when 88 year old Stevens stumbled down a flight of stairs). The Miers pick might have been to get a solidly conservative female/minority vote on the Bench.

The next pick will be easier to nominate the white guy with a scholarly "Scalia" type record like a Luttig, Alito or McConnell.

Think of Miers as taking the up coming vacant seat of Stevens - it's easier to take. lol

Now I don't think that it's helpful to see this nomination as a betrayal. We all see things differently about this nomination and some have been persuaded, some may be open to persuasion later, and some may hold fast. But I don't agree that W broke his promise.
