For anyone who doesn't know, Justice Hecht is the Scalia of the Texas Supreme Court -- long opinions, very scholarly, strict constructionist who is constantly trying to push the Court to the right. He supports Miers without any reservations whatsoever.

Perhaps she will cash her first vote in the case concerning Assisted Suicide. We will see.

I think if she is not there for oral arguments and the decision being issued, she does not vote. The she in this case can be either Justice O'Connor or Justice Mier. This is likely to be an 8 vote decision.

It is interesting how so many have turned on this women exclaiming that she is not qualified to sit in the high court. But I ask, where in the constitution does it set forth criteria for a candidate?

Granted, she may not be the best legal mind in her field, and others may seem to be a better fit, but the President is given the right to nominate anyone he sees fit.

I may not agree with his selection, but arguing she is not fit is nonsense. If she is not, than 90% of America is not....and that is not what the Constitution states.

She is not qualified, that's right. Besides, I feel that Miers was appointed only because she was - among the (short) rest - a lawyer of Bush's family. Anyway, I hope that this lady will behave differently from O'Connor.

P.S. the Constitution doesn't need to state that one should be qualified according to a precise scheme. Anyway she has not a track: What can you say about affirmative action, government spending, property right, gun right, abortion, death penalty?

Exactly my point. The President has every right to nominate anyone he sees fit. It can be anyone....

Given that, it is now up to the Senate to decide her fate. Because she has no track record does not mean she is not worthy. Again, there is no criteria spelled out in the Constitution stating such.

If she is to be denied it will be due to political ideology; the same political ideology that most conservatives frown upon when left attempts to derail conservative candidates.

Do I think she is the best candidate the President could have nominated....sadly no. Do I think she should be voted down...no. Not unless they find something that clearly shows she is not willing to up hold the constitution of the United States. At this time I see no reason, other political beliefs, why she should not be allowed to take a seat on the high court.

The assisted suicide case is one where Miers nor Roberts will be able to please critics. If they for the federal gov the state rights people will be mad. If they vote for oregon the right to life people will be mad.

Some may consider this naive or worse, but I trust the president to make a good choice for this important selection. I don't think the choice was based on cronyism. He has many other friends who could have been chosen if that had been the reason.

Our favorites were JRB, Luttig, and Edith Jones. I don't know all of the reasons why the president chose Miers over these very qualified persons. I was disappointed, and concerned, but the more I learn about Miers, the less disappointed and concerned I am about her nomination.

The president is a man who prays, and I have no doubt that this was a prayerful decision. I know that my family prayed about this decision. I trust in the power of prayer, and the providence of God.

The strong support she has received from Justice Hecht, and others, reassures me that we have less to fear, and more to hope.

The president has three more years in office, Lord willing, and there may be other vacancies to be filled on the SCOTUS during that time.

I pray you are right Lucy....we need someone on the court who will look to God for guidance when attempting to interpret the Constitution as our fathers intended.

Yes, he must know her quite well. According to 10/05/05 article in WaPo, he says this--

"Hecht and other confidants of Miers all pledge that if the Senate confirms her nomination to the Supreme Court, her judicial values will be guided by the law and the Constitution. But they say her personal values have been shaped by her abiding faith in Jesus, and by her membership in the massive red-brick Valley View Christian Church, where she was baptized as an adult, served on the missions committee and taught religious classes. At Valley View, pastors preach that abortion is murder, that the Bible is the literal word of God and that homosexuality is a sin -- although they also preach that God loves everybody."

Yes, Hecht is the reason W can be so sure about Harriet. They've been "keeping company" since the mid-70s. Now I don't want to criticize anybody's lifestyle, but isn't it time for Miers to make an honest man of him?

Some interesting tidbits in the NYT this morning:

"Educated at Yale and Southern Methodist University, he has been closely associated for three decades with Ms. Miers, President Bush's former personal lawyer in Texas, working together at an elite Dallas Law firm, escorting Ms. Miers to evangelical church services and social functions.

"At times he benefited from her financial assistance.

"In 1993, the plaintiff in a whistleblower lawsuit asked Justice Hecht to recuse himself from ruling on a motion filed by Ms. Miers with the Texas Supreme Court. The plaintiff, Kathleen Spears, requested the recusal, according to an article in Texas Lawyer magazine, "because of his friendship and financial dealings with Miers." The magazine reported that Ms. Miers was listed as a guarantor of a loan to Hecht in excess of $25,000, according to Hecht's financial statement filed with the Texas Ethics Commission. Justice Hecht recused himself from the decision.

"Ms. Miers also donated $6,396.84 in 1994 and 2000, when Justice Hecht successfully ran for re-election, ranking among his largest individual contributors, according to Texans for Public Justice, a nonpartisan group that tracks campaign donations in state politics."
