why don't YOU provide ANY link and/or news article where ANY sitting Supreme Court judge has EVER commented on the qualifications of a Supreme Court nominee?

You mean no one has the right to take Scalia's remarks as an endorsement of Miers? OK, then, what Scalia said is irrelevant to any discussion of the Miers' nomination. You can't have it both ways: either he was referring to the Miers' nomination but didn't want to be criticized for commenting on the qualifications of a current nominee, or his remarks are not to be taking as meaning anything pertinent to Miers. That was my point. You either didn't get it, or wanted to distort it.

I mean, you wouldn't try to mislead anybody would you?

I haven't misled anyone here about how long I've been a member, now have I?

You have hit upon the most important fact: that he said anything at all is astounding.

Only the latter might be true.

was BushisTheMan's response and you come back with

Oh, there are not many others who are far better qualified?

Now who is being disengenuous?

You're parsing.

I assume you can't find anything to back up your original statement and have chosen to dodge and weave.

I haven't misled anyone here about how long I've been a member, now have I?

And neither have I. It's not my fault YOU didn't know.

Agreed - Rush is not entirely happy with this pick.

He is viewing this pick as part of the political war with the 'Rats, and hoped it was a chance to drive another stake in their hearts. He holds back on some of his dismay with this pick by noting that with an Army like the Senate Republicans, perhaps it is just as well that we don't go to war now.

From that perspective, he's reasonable to not be enthusiastic about Miers.

I enjoy a good fight too. But I most want a solid vote on the Court. If Miers never writes a single opinion, and never says a word in public again, but is a solid vote respecting the Constitution, that works, for me.

The streak of arrogance running through the anti Miers community troubles me.

That is not the Conservative Republican community I am a part of.

I thank Scalia for his wise and humble comments.

Since you don't like GW, who you supporting in '08. We need to hear from our self appointed Conservative gods!

GW..? Do you mean George Washington, or GWB?
I never said I didn't like President Bush. I have supported him without fail up til now, even on decisions I wasn't entirely comfortable with. I did a lot of work on behalf of his re-election, and many of the bumperstickers I designed supporting him are still on the road. Go to my Member's Page to get one.

I never appointed myself a "Conservative god" and I wouldn't even consider myself a conventional conservative by any stretch of the imagination. If I really got into my personal views, I'm pretty sure I would get myself in trouble with the God Squad around here.

I'm just for common sense: limited government, fiscal responsibility, lower taxes, and a competent, scholarly judiciary that relies on the text of the US Constitution, not foreign law, not the Bible, and not their own sense of "social justice". One of my main problems with Miers is I don't buy Bible study as a singular qualification for the Supreme Court.

But above all, I'm for smart political gamesmanship, something I've seen no evidence of from the White House or much of the elected Republicans in quite some time -- and I'm mad as hell about it.

Regarding who I support for 2008, it's just way too soon to start committing myself to anyone.
I do know that I would like to see Newt Gingrich make a serious run. I would be inclined towards him.
But ultimately, as my first loyalty is to political pragmatism, my support is ultimately with whomever can keep the Clintons out of the White House.

Isnt this hilarious? The same people that want to discount EVERYONE else (ie the pundits like Limbaugh, Levin, etc) --because "BUSH KNOWS HER", are the same people who run right over here and cheer on Scalia, who DOESNT. So which is it?

How do you know he doesn't?

"At any given time, there is ALWAYS somebody MORE qualified for any given job."

The TRUTH is EVERY PERSON KNOWN ON THAT LIST was MORE qualified.

And President Bush picked THE LEAST qualified person who is also NOT a proven conservative.

In so doing, he has split his base. Very poor STRATEGERY on his part.

Miers is nominated to take the place of Rehnquist, as the judge without prior judicial experience.

Actually, President Bush said Miers is the replacement for Sandra Day O'Connor.

BS; he picked who he picked.

You didn't get the pick; if you're not happy, find a candidate that will be the leader of ONLY the extreme right and run them.

Then, if you can get elected, just see how much you can get done without the help of anybody else.

Ya know, all this hullabaloo in trying to stop the President's nomination or having Miers herself withdraw, is very unsavory.

It speaks of ABORTING the Candidate before we get to see and hear from her at the Senate Hearings.

Let the Hearings take place then energize actions to support or nonsupport. If she is revealed not to be worthy, so be it. But if she is worthy, we will all see it.

To do so before is, IMO, joining the darkside of what we are fighting against.

and hoped it was a chance to drive another stake in their hearts

There will be a major battle between two views. It will be a classical Theology VS. Culture battle on the issue of Wisdom and Knowledge.

According to the bible, the beginning of Wisdom is the fear of the Lord. According to culture, all wisdom comes from experience in applying knowledge to situations.

The battle lines that are forming transcend liberal and conservative groups and the sides being taken are defined along the above lines. Some call it the snob /elitist factor but that is only one facet, some call it the religious fundamental factor, but that isn't entirely clear either.

The primary issue is one addressed by King Solomon and made a part of scripture as the Proverbs.

Good comments by Scalia.

Of course, as pointed out, he's merely endorsing the concept of nominees without judicial experience and not Miers specifically. Can't hurt her though.

It's not that Miers may not be a good nominee, it's simply that we don't know that.

A handful of dissatisfied Republicans will join them, and Miers will go down in flames

Will this handful of Republicans be RINOs or Conservatives and will they oppose Miers on the basis of Bush's refusal to ignore Executive/Lawyer-Client privilege?
