Spanish judge issues arrest warrant for three U.S. soldiers over journalist's death

MADRID, Spain (AP) A judge has issued an international arrest warrant for three U.S. soldiers whose tank fired on a Baghdad hotel during the Iraq war, killing a Spanish journalist and one other, a court official said Wednesday.

Judge Santiago Pedraz issued the warrant for Sgt. Shawn Gibson, Capt. Philip Wolford and Lt. Col. Philip de Camp, all from the U.S. 3rd Infantry. Jose Couso, who worked for the Spanish television network Telecinco, died April 8, 2003, after a U.S. army tank crew fired a shell on Hotel Palestine in Baghdad where several journalists were staying to cover the war. Reuters cameraman Taras Portsyuk, a Ukrainian, also was killed.

The Spanish judge said he issued the arrest order because of a lack of judicial cooperation from the United States regarding the case. U.S. officials insist the soldiers believed they were being shot at when they opened fire.

Following the Palestine incident, Secretary of State Colin Powell said a review of the incident found that the use of force was justified. In late 2003, the National Court, acting on a request from Couso's family, agreed to consider filing criminal charges against three members of the tank crew.

I remember this incident. One English speaking journalist at the time said that the response of the tank was not proportional to the threat. Another said that he and some companions (who were in the hotel at the time) were not aware that the hotel had been hit by tank fire.

Either way, this is BS!

well, scratch spain from my next vacation. nobody should worry about this, this judge seems to work only on PRINCIPLE. cant wait till he tries principle on a muslim defendant, hopefully that muslim will be a real good one and we all know what real good ones like to do to infidels heads.

What is an "international arrest warrant" and who enforces it? Any national police force. Remember Pinochet? He was arrested by the British police on a warrent issued be a Spanish investigating judge. The soldiers would be well advised not to travel outside the US. Well, unless they're in their tank obvioulsy.

Guess what happens in wars? People get killed.

Is this moron saying that military personnel should hesitate because a journalist may be in the area? They enter a war zone at their own risk. Period.

Old Europe

Spain slid back in to OLD EUROPE very soon after the trains were bombed in Madrid. I for one will not miss them. Besides, nothing good has come out of Spain since Senior Bulto died.
