President Bush has returned from a weekend in Camp David, where much of the discussion centered on the beleaguered nomination of Harriet Miers. While the president is determined to press forward, the prognosis he received was grim. Her visits with senators have gone poorly. Her written answers to questions from the Senate were sent back as if they were incomplete homework. The nominee herself has stumbled frequently in the tutorials in which government lawyers are grilling her in preparation for her Nov. 7 hearings.

Haven't seen a lot from the pro-Meiers side since she was unmasked as a quota-queen.

About Legacy
Purpose
To educate and raise awareness among Latter-day Saints on public policy issues compatible with "The Family: A Proclamation to the World" and teachings of LDS Church leaders. We are focused to train legal professionals to strategize, advocate and litigate for principle-based family policies in the public square.


They wouldn't support Miers because she isn't LDS and is childless, and does not have the "litigating" experience for principle (codeword for religious) based family policies they are looking for.

Please, someone convince me we aren't facing the possibility of losing as big as we did with Kennedy in this crapshoot, should we get our wish for a proven judicial conservative.

So, imagine that you are someone else besides yourself, and you are reading this post of yours and trying to figure out what you are intending to say. What is it?

My only worry now is who the president will appoint after Ms Meirs goes down.

I'm hearing he's a big fan of his butler, who had to appear in traffic court once. So he's probably got a "common sense" approach to libertyfying and governmentalating and all.

As soundly and repeatedly as the shrill shills of the Aunt Harriet Hallelujah Choir have had their pin-headed "arguments" spanked over the past two days: we'll doubtless be subjected to far fewer of their assorted mewlings and whinnyings between now and the inevitable withdrawal of their patron saint's absurd, meritless nomination. :)

A. That website-and its proprietor-don't take a position, with regard to the Miers confirmation. The web-page I posted merely laid out all of the arguments, pro and con, that had been made in the initial week following her nomination.

B. If anything, it was weighted-heavily-in favor of the pro-Miers side, which anyone who crosschecked each argument-and analyzed the relative validity of each one-would realize.

C. As far as I know, none of the arguments bore any relation to the Church of Latter Day Saints, which I believe is neutral on SCOTUS appointments.

In fact, it became clear Ms. Miers is a complete mystery. "We spent about 1,200 hours together and had in excess of 6,000 agenda items, and I never knew where Harriet was going to be on any of those items until she cast her vote," Jim Buerger, a former Miers colleague on the Dallas City Council, told the Washington Post. "I wouldn't consider her a liberal, a moderate or a conservative, and I can't honestly think of any cause she championed."

When Martin Bubur was asked about power, he explained power was needed in life to accomplish goals, and that power only became corrupt or evil when it was sought after only for it's own sake. It's not comforting when a look at Miers issues tells us the only reason she's in public service is for her own benefit.

The lesson of this and Mike Brown-gate is to appoint the best man or woman for every job, not just your buddies.

That's one lesson. Another is that if you have settled for "less than the best," explain why that is the case (e.g., 60 vote hurdle, don't want a fight, etc.).

Another is to not insult supporters who provide reasoned criticism.

Another is to be a good listener - and to be appropriately responsive, considering the merit (or lack) of the criticism.

That is a good one too. Don't call those who gave you countless volunteer hours, and hundreds of millions of dollars "sexists," and "elitists."

The only debate that should be taking place-in my opinion-is between the "Constitution in exile" scholars and the textualists.

I might agree with the Bork/Scalia model-when it comes to legislative and executive discretionary powers not being encroached upon by the courts-and the Thomas/D. Ginsburg model-as far as upholding core Constitutional values is concerned, e.g. property rights, the correct interpretation of the commerce clause, etc.,-but I don't believe that either approach is wholly meritless.

However, I can't say the same of the ad hoc, politically expedient, self-absorbed approach taken by the Breyer school on ALL of these issues.
