With Alito's dissent on Planned Parenthood v. Casey I don't see how he is any less likely to provoke a filibuster. The dance in the Senate is all about abortion, when you cut right down to it.

Let the abortion-crazed Dems make an issue out of Judge Alito believing a married father has a right to know when his baby is about to be killed. BRING IT ON, KENNEDY! BRING IT ON, HILLARY! Let's have this fight already. The American people will agree with Alito - and Rehnquist - that fathers should have that right.

But take the argument one step back - Alito and Rhenquist are saying that the people could decide this issue the other way, but need to get it by the legislature.
