With Alito's dissent on Planned Parenthood v. Casey I don't see how he is any less likely to provoke a filibuster. The dance in the Senate is all about abortion, when you cut right down to it.

Let the abortion-crazed Dems make an issue out of Judge Alito believing a married father has a right to know when his baby is about to be killed. BRING IT ON, KENNEDY! BRING IT ON, HILLARY! But take the argument one step back - Alito and Rhenquist are saying that the people could decide this issue the other way, but need to get it by the legislature.
