The system is broken and probably is broken intentionally. Until people start demanding clear laws with safeguards, we are stuck with the laws of our states. There should be federal laws on forced exits since the Constitution doesn't seem to be worth a hill of beans nor does the bill of rights or the Declaration of Independence.

Be sure and have a wonderful Thanksgiving.

You know the NY legislature is now working on a bill concerning the order of priority for health care decision makers if a person is incapacitated. From what I've read (see the North Country Gazette), it has no safeguard if the legal decision maker is actually abusing the person they are supposed to be caring for. Let me quote the SC ombudsman's office: "...it is not in the purview of this department to determine whether the medical decision maker is MAKING DECISIONS THAT ARE IN THE BEST INTEREST OF THE PATIENT OR NOT." The ombudsman was referring to the SC law prioritizing the order for HC decision makers. Seems that sort of safeguard should be in the law, but my guess is that you are correct -- it would be hard to cover up if you actually had clarity in the law.
