CIA leak prosecutor sees new grand jury proceedings

Special prosecutor Patrick Fitzgerald said in court filings that the ongoing CIA leak investigation will involve proceedings before a new grand jury, a possible sign he could seek new charges in the case.

In filings obtained by Reuters on Friday, Fitzgerald said "the investigation is continuing" and that "the investigation will involve proceedings before a different grand jury than the grand jury which returned the indictment" against Vice President Dick Cheney's chief of staff, Lewis "Scooter" Libby.

Fitzgerald did not elaborate in the document. For two years he has been investigating the leak of covert CIA operative Valerie Plame's identity. The grand jury that indicted Libby expired after the charges were filed late last month.

President George W. Bush's top political adviser, Karl Rove, was not indicted along with Libby. But lawyers involved in the case said Rove remained under investigation and may still be charged.

A face-saving measure by Mr. Fitzgerald. The case against Libby is absurd. He was commissioned to investigate whether there was a leak of classified information in the outing of the Plame dame. There wasn't. That should have been the end of his investigation.

To investigate WHAT crime?

It has become clear that Valerie Plame was not a covert CIA operative, and that her identity had already been "leaked" by both herself and her husband. What is the putative crime that the investigation is supposed to investigate??

While I like the popcorn; what a cushy job, no one really has to do anything except say they are investigating, probably have pretty cool offices, nice lunches, per diem, a nice hotel in Washington, fly home for the weekend. And the best he has is at worst a guy lied about telling the truth, most likely the guy forgot a short conversation from 2-3 years ago and when he tried to clarify it, got nailed for lying.

A decade from now, when this investigation over a non-crime is wrapping up, and the multi-million dollar budget is being tallied, we'll have all forgotten what it was all about.

The only reason I don't oppose the "independent prosecutor" concept is because most of the time, they are directed at agents and operative of FedGov, and time spent harassing their own is time they won't be spending harassing the rest of us.

From my reading of the law, this entire investigation should have taken at max two weeks.

Woodward's source was the one who told Fitzgerald that he had told Woodward. That's the only reason Woodward even came forward. Fitzgerald already knows. Woodward just isn't publicly disclosing who his source was.

He almost needs a new grand jury to get him off the hook for not having covered all bases in the first investigation. The Woodward issue has changed everything and his indictment of Libby now looks foolish. He is just covering his you know what so that he does not have to dismiss the libby indictment. He will let the new grand jury do it for him..

I think Woodward already did.

Or more accurately, Woodward didn't have to disclose his course to Fitzie because Fitzie already knows the source.

(As I understand it, the source is the one who went to Fitzie about his conversation with Woodward -- not the other way around.)

Btw, the conventional wisdom seems to be that the source is likely Colin Powell, because of the way Woodward phrased it ("former administration official") in at least one instance; and because Powell is supposed to be pretty cozy with Woodward.

The author of this article, Adam Entous, evidently feels unconstrained by the truth when writing his "news" report.

Take a look at these excerpts from the Transcript of Special Counsel Fitzgerald's Press Conference and it will become immediately apparent that there is no new news here, and Fitzgerald specifically said to the press (who must have blocked their ears) that it would be routine and expected for him to either empanel a new grand jury (since the old one had expired), or to make use of some other grand jury, and not to draw conclusions from his actions in that regard. Of course, "journalists" don't need no stinkin' facts in order to write their "newsitorials".

Here is the excerpt:

FITZGERALD: Let me answer the two questions you asked in one.

OK, is the investigation finished? It's not over, but I'll tell you this: Very rarely do you bring a charge in a case that's going to be tried and would you ever end a grand jury investigation.

. . .

FITZGERALD: This grand jury's term has expired by statute; it could not be extended. But it's in ordinary course to keep a grand jury open to consider other matters, and that's what we will be doing.

. . .

QUESTION: You noted earlier that the grand jury's term expired but you said something about holding it open. Or will you be working with a new grand jury?

FITZGERALD: The grand jury, by its terms, can serve -- was an 18-month grand jury. By its statute, to my understanding, can only be extended six months.

FITZGERALD: That six months expired.

It's routine in long investigations that you would have available a new grand jury if you needed to go back to them. And that's nothing unusual. I don't want to raise any expectations by that; that's an ordinary practice.

. . .

QUESTION: Just to be clear -- you did touch on this earlier -- with the grand jury time being done, you have no plans to file another grand jury related to this case at all, is that correct?

FITZGERALD: No. I think what I said is we could use any other grand jury or avail of another grand jury. We couldn't use the grand jurors whose term has expired today any further.

Julie Jordan, People magazine: "Yes. Yeah like we got lots of smart men. Patrick Fitzgerald. I love that he actually is..."

Couric: "The special prosecutor. Oh my gosh he must've been so freaked out when he got the call! He keeps dirty socks at work and apparently has pizza boxes up to the ceiling at his house."

You could see at the indictment press conference that Fitz and the media were warming to each other, that Fitz was enjoying the limelight and the fawning adulation. Apparently he wants to keep it going. Even prosecutors need love, and apparently Fitz has none in his personal life.

I have to wonder if there isn't something else going on behind the scenes... It feels like a play I'm watching.

Do we think our side is smarter than the Dems or not?

Before the Libby indictment, the descriptions of Fitzgerald that I read did not make him sound like a Ronnie Earle. *shrug* I actually believe he is a good prosecutor.

He indicted Libby, and Libby didn't take a plea bargain - like most politicians would!

Now the question is, if he reopens a new Grand Jury, what will he be investigating? "the leak"? Or will it be something else? Will it be a broader investigation?

What if, just for optimism and giggles sake, what if Fitzgerald really wants to get to the root of this matter - a rogue CIA working in opposition to the President? What if the power people decided behind the scenes that in order for this story to walk, you had to get the left behind Fitzgerald? They had to indict a "pubbie" first so that they couldn't pull a Ken Starr on him?

Just a hopeful wish...
