Now that we've given the cause a name, all we gotta do is get Alito in there in spite of Binden and then bring a case up for re-visiting. I like your analysis. The whole point to having a legislative body that isn't based on population is to make sure that the big fish can't go around gobbling up the little fish.
There is no way to make the system perfect, but without some sort of true bicameral legislature, the only recourse is the courts... and we know how much we like doing that as conservatives.
