Judge puts off ruling on Delay dismissal

AUSTIN, Texas (Reuters) - Attorneys for U.S. Rep. Tom DeLay sought the immediate dismissal of conspiracy and money laundering charges against the once-powerful Republican on Tuesday, but a Texas judge said he would not rule for two weeks in the case that has derailed DeLay's political career.

Judge Pat Priest, new to the case after DeLay complained the previous judge was too close to the Democratic Party, also said he was unlikely to hold a trial before year's end if he did not throw out the indictments.

"This is not the only thing on my plate," he said.

DeLay has pushed for a quick resolution because he wants to regain the House majority leader position he had to resign when he was indicted in Texas in September. Any delay hurts his chances because a vote on the next majority leader is set for January.

In a show of support for DeLay, it was announced that Vice President Dick Cheney plans to attend a December 5 fund-raiser for him in Texas.

"Congressman Tom DeLay has been an exceptional leader on Capitol Hill and Vice President Cheney looks forward to helping his re-election effort," said Cheney spokeswoman Jennifer Mayfield.

Yup the Dems want to see him where he is because to their mind it hurts the GOP. And there are many in the GOP that like to see him where he is because it helps them climb the power ladder in the halls of washington.

If its dismissed, in my opinon the republicans will vote Delay back in to shove it in the face of the dems. Two weeks from now its early december, plenty of time.

Yep. This judge appears to be taking DeLay's request seriously. Also:

That actually sounds encouraging.

This judge is in the same circumstance as the one in Miracle on 34th Street. He can't summarily dismiss today with the demos breathing fire. Perhaps he'll thread the needle with an appropriate decision soon.

Can the Repubs do that or do they have to change the House rules (that one that is only applicable to Repubs)?

Wow, one little complaint and they get a whole new judge!!

How about this: The new judge was assigned because the first one was a devout follower of George Soros, and it was public knowledge that he was a partisan hack.

If the charges are dismissed on 12/24, the GOP can have its own version of Fitzmas. Watch the DUmmies go nuts (nuttier).

The money laundering charge is bs because the funds were not the result of a crime. The conspiracy charge is bs because there was no crime of conspiracy to violate the election laws at the time the so-called crime occured. Net result, 95% chance this case gets tossed, unless some interest group has gotten to the judge.

I hope so because he is on the receiving side of prayers asking for him and his family to receive the identical type of justice that he generates in this case.

It is time for some of us to see that God's will is brought to bear on the justice system in this Nation founded largely on the laws of the Bible.
