If he's 19 and she's 17, the police should arrest and charge him for statutory rape. Why hasn't that happened?

In most states, it's not statutory rape if there is less than a 3 year age difference.

In most states, 17 is 'legal'.

It varies on the state. The same holds true with age of consent--which would determine whether this is statutory rape.

In my state, it generally is an unwritten rule--prosecutable, but often not. While I'm not a lawyer, I've seen news stories on both sides--mainly involving whether the district attorney decides to prosecute.
