Michael A. Cardozo, New York City's corporation counsel, asked the judge to issue an order directing union members to return to work. If the order is granted, Cardozo said, the city could ask for $25,000-a-day fines per worker a punishment that goes beyond the docked-pay penalty that workers already are experiencing for the illegal strike.

By this time this is over the fines will be dropped and the union will get what it wants. Toussaint may see a few days of jail time but it won't hurt him and he won't lose any money by it.

The real bone of contention is the pension plan. Management knows the union's plan is simply insupportable in the near and long term. The union members don't want to have to fund much of their pension, starting at 55.

The only thing that will fix this is the Reagan approach. Fire all of the striking workers then set about replacing them.There will be more discomfort than an immediate cave will induce but it won't happen again. That would take a Giuliani as mayor and NYC doesn't have one of those any more.

Yep, the judge has to make it personal. To fine "the union" is one thing, but to make an individual responsible for paying the fine out of his own pocket is another.

According to a prior article the city is losing $400 million a day from the strike. They need to up the ante to make it hurt. I say fire the bastards.
I'm so glad I no longer live in New York.

Fire 10% of the work force each day they are out. After 10 days offer to hire them back at 50% increase in salary provided they contribute for their own health care, contribute for their own pension, retire at 62 and give up retiring at 1/2 pay. In addition, the State will fund immediately 50% of the 1/2 retirement pay into their pension accounts.
That should break the union.

It's a good approach but it still takes a Giuliani and a cooperative judge. A 10% plan would go a couple of days, the city would cave and all would be forgiven and everyone rehired. I have NO faith that NYC will do anything intelligent in such a situation.
