I guess at some point a court order would be required but one of my best friends was an IRS Special Agent. I have talked to him quite a bit about what they could and couldn't do.

He carried blank summons' in his brief case. If he needed info or private records he would simply issue a summons for them. He technically didn't even need to issue the Summons but some would request one for their own protection before releasing the info.

STuff happens all the time that doesn't require a warrant.

That's because only UNREASONABLE SEARCHES require a warrant.

I don't know about the legality, but I think you can be fairly certain that if George Bush obtained all the banking information from anybody who received their debit card via an ACLU program, the headline on tomorrow's NY Times would be in "Man Walks on Moon" font.

Basically a list of who called who and for how long does not require a warrant. Its a good way for law enforcement to track who the terrorists make calls to and to quicly establish terrorist networks. Also call data is used to track child abductors etc.

The NSA doesn't do wiretaps either. Not you specifically, ocean...but I wish people would stop refering to this as wiretapping. It is as different from wiretapping as is a personal search.

They are simply filtering huge numbers of data packs, looking for a pattern.

One filter may be taking flight lessons. No big deal in and of itself, but if it is combined with frequent phone calls to the ME, and the word "Jihad" is mentioned frequently, perhaps you may be in the filter mechanism, and get a closer look. Probably still nothing to get alarmed about. But those phone calls to OBL are going to get you snared.

They don't give a rats ass if you are talking on your phone about running down the street to buy an ounce of weed, and couldn't use it in court anyway.
