Well I'm not an attorney, but I did sleep in a Holiday Inn Express some time ago.
This case will be tossed. I would think the loon would have to at least have some proof of damages.
Forget damages. He has to prove standing.
He's not sueing because he thinks he was wiretapped. He is sueing because he thinks the President's use of it without warrants is unconstitutional. Of course he is wrong, and maybe he does need to be wiretapped just to get some humorous material from when Ted calls and congratulates him.

They could care less about FACTS of any kind, it's just one more thing to throw at the wall and see if it sticks...
