I would be stunned if the far left LOUSE-enberg were to vote yes. What about Bayh, has he declared himself yet? It's getting pretty late. I think some of these people don't ever want to decide.

New Jersey is a state with an enormous and influencial Italian American community that takes these things very seriously. Ya never know!

With Evan Bayh it's all about positioning himself for a run for President. I know someone who was a staffer for him in Washington as well as in Indiana. They finally left in disgust because every decision Bayh made was based solely on how it would affect his presidential chances, not on what was best for his constituents. So you can figure Evan is calculating every angle of this and he'll take the position that he thinks will help him the most, politically.

Actually this is a rather interesting situation. Bayh comes from a fairly conservative state and normally I would think he would be inclined to vote for Alito. On the other hand, he would like to be President and he probably figures he needs to appeal to the far left base to get funding and votes in the primaries.

I say he votes for cloture but votes against Alito.
